Terms of Service

These Terms of Service are intended to govern the relationship between you and HONG KONG ZHONGYUEYUN TECHNOLOGY CO., LIMITED (hereinafter referred to as “Cloud Joy Games” or “we/us”) and constitute an agreement for the provision of services by electronic means (hereinafter referred to as the “Agreement”).

They govern the manner in which you use Cloud Joy Games’ mobile and online services, including our mobile and web applications (hereinafter referred to as the “Applications”), games provided through the “Applications” (hereinafter referred to as the “Games”), our website (mhfish.com) and its subdomains (hereinafter referred to as the “Website”), or our content on third-party websites or applications (hereinafter referred to as “Third-Party Platforms”), as well as other platforms, websites, products, and offers and services that we may provide from time to time (all of the foregoing collectively referred to as the “Cloud Joy Games Services”).

Before accessing or using the “Cloud Joy Games Services”, you must accept these Terms of Service and carefully read the Privacy Policy. Certain “Cloud Joy Games Services” may require registration of an account (hereinafter referred to as an “Account”) in order to be used.

If you access and use the “Cloud Joy Games Services” through social media websites such as Facebook or other “Third-Party Platforms” (Google, Apple), please comply with their terms to the extent governed by their terms of service, and use the “Cloud Joy Games Services” in accordance with these Terms of Service.

If you do not accept any part of the current version of these Terms of Service, you may terminate the “Agreement” and stop using the “Cloud Joy Games Services”.

§1[Ownership and Restrictions on Use]

Cloud Joy Games is the exclusive owner of the “Cloud Joy Games Services”.

All related rights, title or interests in and to the “Cloud Joy Games Services”, and the elements of the “Cloud Joy Games Services” (including but not limited to any “Games”, their concepts, themes, objects, characters, character names, stories, dialogue, catchphrases, images, animations, audio, musical works, audiovisual effects, methods of operation, chat text transcripts, character profile information, “Game” save data, and software, logos, graphic design elements, trademarks, databases, text, information, statements, images, photographs, designs, and other materials and content, graphics, interactive content, video and audio content displayed and/or used in or together with the “Cloud Joy Games Services”, as well as any underlying elements of the “Website” or “Applications”, including but not limited to source code, object code, and any documentation relating to the operation of the “Website” or “Applications” or the “Content”) are protected by law. Cloud Joy Games reserves all rights, including but not limited to all intellectual property rights or other proprietary rights in the “Cloud Joy Games Services”.

Other company, product or service names mentioned in the “Cloud Joy Games Services” may be trademarks or service marks of their respective owners.

Nothing in these Terms of Service shall be construed as granting you ownership of the trademarks, service marks, trade names, copyrights, other intellectual property rights or other rights in the “Cloud Joy Games Services” or any elements thereof. You may use the “Cloud Joy Games Services” only in the manner expressly permitted by these Terms of Service. Any other access to and use of the “Cloud Joy Games Services” shall require the prior written permission of Cloud Joy Games.

§2[Licence]

If you accept and continue to comply with these Terms of Service, Cloud Joy Games grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited licence to access and use the “Cloud Joy Games Services” for your own non-commercial entertainment purposes. You agree not to use the “Cloud Joy Games Services” for any other purpose. This licence shall cease to be effective upon termination of the “Agreement” with Cloud Joy Games in respect of the particular Cloud Joy Games Service.

§3[Restrictions on Use of the “Cloud Joy Games Services”]

When using the “Cloud Joy Games Services”, do not breach the following restrictions, otherwise your “Account” and/or any other “Cloud Joy Games Services” (for example: Games, Chat) may be suspended or blocked. Cloud Joy Games shall notify users in advance of any intended suspension or termination, state the reasons for such action, and provide users with an opportunity to respond, unless immediate action is required under applicable law to prevent harm or illegal activity. You agree that under no circumstances will you engage in any of the following conduct:

Use such services in a manner inconsistent with the nature and scope of Cloud Joy Games’ customer service, in particular by asking other users for information such as personal data or game scores.

Engage in, use or participate in (directly or indirectly) cheating, exploits, automated software, bots, cheat plug-ins, mods, or unauthorised third-party software used to modify or interfere with the operation of the “Cloud Joy Games Services”.

Modify any files that are part of the “Cloud Joy Games Services”, or cause such files to be modified, without the express written permission of Cloud Joy Games.

Interfere with or adversely affect the normal operation of the “Cloud Joy Games Services”, or, when using the “Cloud Joy Games Services”, engage in conduct that may adversely affect the experience of other users, including win trading and any other manipulation of rankings, exploiting errors in the “Cloud Joy Games Services” to obtain an unfair advantage not available to other players, and any other conduct that intentionally abuses or violates the design of the “Cloud Joy Games Services”.

Interfere with or overload computers or servers used to provide or support the “Services”, or assist in such conduct.

Engage in, assist with or participate in any kind of attack against the “Cloud Joy Games Services”, including but not limited to distributing viruses, denial of service, or other conduct that interferes with the “Cloud Joy Games Services” or affects any person’s use of the “Cloud Joy Games Services”.

Attempt to obtain unauthorised access to the “Cloud Joy Games Services”, an “Account” registered for another person, or computers, servers or networks connected to the “Cloud Joy Games Services” other than by using the user interface provided by Cloud Joy Games, including but not limited to circumventing or modifying, attempting to circumvent or modify, or inducing or assisting others to circumvent or modify any security mechanism, technology, device or software that is part of the “Cloud Joy Games Services”.

Harass, abuse or harm any person (including Cloud Joy Games employees and Cloud Joy Games customer service representatives), or attempt to engage in, assist with or cause such conduct.

Reconstruct, reverse engineer, decompile, disassemble, interpret, or attempt to derive the source code of any underlying software or other intellectual property used to provide the “Cloud Joy Games Services”, or obtain any information from the “Cloud Joy Games Services” by methods not expressly permitted by Cloud Joy Games.

Solicit login information, other login credentials or personal data from other users of the “Cloud Joy Games Services”.

Distribute spam content (for example, unsolicited commercial information).

Engage in commercial, advertising or promotional activities, unless separately agreed with Cloud Joy Games.

Repeatedly send the same message, or send many different messages at an extremely high frequency (flooding/spamming).

Abuse the return policies of third parties (such as Apple or Google) by frequently and repeatedly requesting refunds, or by continuing to use the “Content” after receiving a refund.

Post or share illegal content within the Cloud Joy Games Services.

Use “Support”, “Help”, “Contact” or similar tags in a manner inconsistent with their intended purpose, including making false reports concerning illegal content with the intention of harming other users or misleading Cloud Joy Games staff.

§4[Users]

To become a user of the “Cloud Joy Games Services”, you must be a natural person who satisfies the following conditions: your conduct is for purposes unrelated to your commercial or professional activities; you are at least 18 years old at the time of registering an “Account” or have reached the legal age required under the applicable laws of your place of residence; and you have full capacity to perform legal acts (hereinafter referred to as a “User”).

By choosing to accept these Terms of Service and access the “Cloud Joy Games Services”, the User confirms that he or she is at least 18 years old or has reached the legal age required under the applicable laws of his or her place of residence, and has full capacity to perform legal acts. Cloud Joy Games reserves the right, where required by applicable law, to implement additional measures to verify a User’s age and legal capacity.

You understand that the content included in the “Cloud Joy Games Services” may be suitable only for “Users” who have reached the legal age, and therefore you assume the related responsibilities and risks of using the “Cloud Joy Games Services”.

§5[Personal Data]

To access and use the “Cloud Joy Games Services”, you may be required to provide personal data to Cloud Joy Games, and Cloud Joy Games will collect, use and disclose such data in accordance with the Cloud Joy Games Privacy Policy (hereinafter referred to as the “Privacy Policy”). To view the Privacy Policy, please visit https://mhfish.com/privacy/index.html.

Cloud Joy Games will process your personal data in accordance with the terms of the Privacy Policy.

§6[Technical Requirements for Use of the “Cloud Joy Games Services”]

Access to the “Cloud Joy Games Services” requires hardware (including a Microsoft Windows or macOS computer running the latest operating system, or an Android or iOS mobile device), a web browser that supports cookies, and an internet connection. Specifically, the supported browser types include the latest versions of Google Chrome, Mozilla Firefox and Microsoft Edge. To ensure the proper operation of the “Games” and the “Cloud Joy Games Services”, you may be required to install plug-ins, and you must provide an email address during registration.

For various reasons (including but not limited to system security, stability and multiplayer interoperability), Cloud Joy Games may need to automatically update or improve the “Cloud Joy Games Services”, and the technical requirements for using the “Cloud Joy Games Services” may therefore change over time. You agree to such automatic updates as are necessary for system security, stability or interoperability. Users will be notified of any material updates or changes to technical requirements that may affect their ability to access or use the “Cloud Joy Games Services”.

Cloud Joy Games does not guarantee that you will be able to access or use the “Cloud Joy Games Services” at the time or location of your choosing.

You may be required to install the latest version of the operating system for the device you wish to use in order to access the respective “Cloud Joy Games Services” and to ensure that the particular “Cloud Joy Games Services” operate properly. Please install such updates in accordance with the recommendations of the manufacturer of the device and the relevant operating system.

When accessing the “Cloud Joy Games Services” through online, wireless or other telecommunications services, you shall bear all related charges, such as charges incurred for browsing websites, sending messages, and using data network services of internet service providers or mobile network operators.

§7[“Cloud Joy Games Services”]

Subject to these Terms of Service, Cloud Joy Games may provide you with the following:

“User Account”,

“Games”,

“Content”,

“Chat”,

“Subscription Plans”.

§8[Formation, Termination and Performance of the “Agreement”]

The “Agreement” for the “Cloud Joy Games Services” is formed when the following occurs:

“Account”, “Games” and “Chat”: Cloud Joy Games provides the “Account”, “Games” and “Chat” to you or your device;

“Content”: the “Order” created by you has been confirmed, namely you have selected the appropriate button to confirm the creation of a payment obligation.

When Cloud Joy Games deletes an “Account”, the “Agreement” applicable to the “Account”, “Games” and “Chat” is terminated.

Cloud Joy Games shall be deemed to have performed the “Agreement” when the following occurs: provision of “Content”: Cloud Joy Games provides the ordered “Content” to you for use in the Game;

Other “Cloud Joy Games Services”: you or your device accesses such “Cloud Joy Games Services”.

Cloud Joy Games shall be deemed to have performed the “Agreement” when the following occurs:

Provision of “Content”: Cloud Joy Games provides the ordered “Content” to you for use in the Game;

Other “Cloud Joy Games Services”: you or your device accesses such “Cloud Joy Games Services”.

Cloud Joy Games shall commence performance of the “Agreement” (provision of “Content” or services) promptly after the “Agreement” is formed; however, if you are required to make payment under the “Agreement”, Cloud Joy Games shall commence performance of the “Agreement” after you have made payment correctly and Cloud Joy Games has received the payment. In the case of provision of “Content”, this may take up to 24 hours.

If Cloud Joy Games fails to perform its obligations described in Article 4 above, you may request Cloud Joy Games to perform its obligations. In such case, Cloud Joy Games will use reasonable efforts to perform its obligations in a timely manner, or within an additional time limit separately agreed with you. If Cloud Joy Games fails to do so, you have the right to seek remedies.

§9[“Account”]

Use of the Cloud Joy Games Services may require you to register a user account (each an “Account”) directly within the Cloud Joy Games Services or on a Third-Party Platform such as Facebook, Google or Apple, if registration is necessary for access to and use of the Cloud Joy Games Services. In such case, the purpose of registration is to perform the Agreement.

To register directly, please complete the electronic form and provide the requested information, in particular your email address. After the address is verified through the verification link sent to that email address, the “Account” will be created.

If you register or access specific “Cloud Joy Games Services” through a “Third-Party Platform”, an “Account” will be created once your personal data has been verified and you have logged in to that platform.

To register directly, you must set a user name and password (hereinafter referred to as “Login Information”). You may change your user name and password in the “Account” at any time.

You must keep the “Login Information” confidential. Do not share your “Account” or “Login Information” with anyone, allow others to access your “Account”, or engage in any other conduct that may compromise the security of your “Account”. If you become aware of or reasonably suspect a security issue (including but not limited to the loss, theft or unauthorised disclosure of “Login Information”), you must immediately notify Cloud Joy Games and change your “Login Information”.

You may not use any other “User’s” “Account”.

If your Account or Login Information is used by another person due to reasons attributable to you and you suffer any loss as a result, Cloud Joy Games shall not be liable. Cloud Joy Games has implemented appropriate measures to safeguard the security of Accounts, and you remain responsible for maintaining the confidentiality and security of your Login Information.

For any issues relating to unauthorised use of your “Account”, you may email Cloud Joy Games through the “Support” section of the “Website” or the “Help” section of the “Account”.

Each “User” may have only one “Account” in a single “Service” at any one time, unless Cloud Joy Games agrees that you may use one shared “Account” for the various “Services” that form part of the “Cloud Joy Games Services”.

You may not purchase, sell, rent or gift an “Account”, create an “Account” using a false identity or false information, create an “Account” on behalf of any person other than yourself, or attempt to do any of the foregoing.

You may make purchases and payments in the “Account”. You hereby represent that you are authorised to use the payment method linked to the “Account”. You must comply with any rules applicable to the “Account”, including rules on payments and purchase transactions.

You may store certain information in the “Account” (in particular information relating to the progress of “Games”), and upload a personally identifying image (hereinafter referred to as an “Avatar”) and “User Content”.

You understand and agree that you do not have ownership of the Account, and that all rights relating to the Account are owned by Cloud Joy Games. This does not affect your right to access paid Content or services. If it is necessary for security reasons, or in order to exercise its ownership rights, properly provide any services, or remove illegal content, Cloud Joy Games has the right to log in to and operate your Account.

§10[“Games”]

Cloud Joy Games will provide “Games” to “Users”. To play the “Games”, you need an “Account” that authorises you to play the “Games” free of charge.

You do not have the right to update the “Games” or correct any errors yourself. If you discover an error, please promptly report it to Cloud Joy Games through the support channels described in §34 or by other means. Cloud Joy Games is responsible for ensuring the conformity of the “Games” in accordance with applicable consumer protection laws, including correcting any defects that affect their normal operation.

Detailed descriptions, rules, and “Content” of the “Games” are included in the “Games”.

Cloud Joy Games reserves the right to discontinue the provision of a specific “Game” based on factors relating to taxation, economic efficiency, or development strategy. In such cases, Cloud Joy Games shall endeavour to inform users of such decision in a timely manner and shall terminate the provision of the “Game” in accordance with the procedure described in §25. If the termination affects any purchased content or services, Cloud Joy Games will ensure compliance with users’ rights and possible remedies as required under applicable consumer protection laws, including providing refunds or other appropriate measures where necessary.

§11[CHAT]

Chat means any area, page, or feature provided as part of an account or game that allows users to send, transmit, post, display, create, disseminate, and/or view User Content, and/or to communicate, share, or exchange User Content with other users.

To use Chat, you must have an account.

You acknowledge that Chat and the User Content therein may be designed for public rather than private communications. Given the nature of the Chat services provided, Cloud Joy Games cannot guarantee that data transmitted in Chat will be monitored or managed. Accordingly, you understand that any content you send, post, transmit, communicate, share, or exchange through any Chat may be seen by other users and, therefore, you should not expect such transmitted or posted content to be private.

Cloud Joy Games cannot guarantee that other users will not use User Content. Therefore, you should not post ideas or information in the Cloud Joy Games Services that you wish to keep confidential and/or do not want others to use. Cloud Joy Games is not responsible for evaluating or using any User Content and assumes no liability for compensation in connection therewith.

Cloud Joy Games is not responsible for the conduct of users who post User Content in any Chat. Although Cloud Joy Games is not obliged to conduct ongoing moderation, it will promptly remove illegal content once it becomes aware of it.

Users may communicate through chat rooms, forums, groups, and similar channels provided by third-party platforms (such as Facebook or X). These platforms are outside the scope of the Cloud Joy Games Services and are governed by the rules of the third-party platforms.

Cloud Joy Games has no obligation and will not conduct continuous monitoring of User Content shared in Chat. If illegal content is found in Chat, Cloud Joy Games reserves the right to issue a warning to the user or impose corresponding sanctions, including revoking access to selected or all Cloud Joy Games Services in accordance with §25, and suspending or deleting the user’s account. Unless immediate action is required, Cloud Joy Games will implement the relevant measures only after notifying the user and allowing the user to respond.

§12[Subscription Plans]

As part of the Cloud Joy Games Services, Cloud Joy Games may offer various subscription plans. A subscription plan is a Cloud Joy Games Service under which specific features provided by Cloud Joy Games may be used for recurring fees, according to the terms of the selected subscription plan.

A subscription plan may begin with a free trial period, during which the user may use all features of the selected plan free of charge. In accordance with §12(6), if the user does not wish to continue subscribing to the paid subscription plan, the user should cancel the subscription at least 24 hours before the end of the trial period. After the trial period ends, the first billing cycle will begin, and the user’s account will be charged automatically according to the selected subscription plan.

Unless the user deactivates the subscription plan at least 24 hours before the end of the current billing cycle, the subscription plan will renew automatically. The subscription plan fee will be deducted from the account provided by the user within 24 hours before the current subscription plan expires.

If the user decides to upgrade the subscription plan to a higher tier, the change will take effect immediately after the user confirms the intention to change the subscription plan. The funds corresponding to the unused portion of the lower-tier subscription plan will be refunded to the user on a pro rata basis.

The user may downgrade to a lower-tier subscription plan, and the change will take effect at the beginning of the next billing cycle. Until then, the user will continue to use the subscription plan in effect before the change.

The user may cancel the subscription plan at any time in the settings of the third-party platform account. No subscription plan fee will be charged if cancellation occurs during the trial period.

7. If the user cancels the subscription plan after the trial period ends, the user will be able to use the subscription plan features until the end of the current billing cycle. Fees for this period are non-refundable.

Cloud Joy Games may, in its sole discretion, change the fees for subscription plans at any time. Any fee change shall not take effect earlier than 30 days after the user has been notified of the change. Any fee change will be notified to the user at least 30 days in advance.

By choosing to accept a subscription plan, the user agrees that the subscription service will commence immediately and declares that the user has been informed that the right to withdraw from the contract will be lost after the service commences. The user acknowledges that, once access to the content covered by the subscription plan is obtained, the right to withdraw from the contract is lost, and the subscription plan fees already paid are final payments and are not refundable on a pro rata basis even if the subscription is cancelled during a billing cycle that has already commenced.

§13[“Content”]

“Content” means special options provided to “Users” in the “Games”, specifically including items, upgrades, and virtual currency (hereinafter referred to as “Game Currency”; such items collectively, “Content”). “Content” may vary by “Game”.

“Content” may be obtained in the following ways: a) earned during gameplay; b) granted free of charge by Cloud Joy Games; c) purchased for a fee, the actual amount of which may change over time (increase or decrease), provided that such changes apply only to future transactions and do not affect previously purchased “Content”.

The applicable fees will be displayed in the “Game” together with the relevant “Content”. Fees include all applicable taxes, in particular value-added tax.

Cloud Joy Games reserves the right to change the pricing of “Content” in the “Games” at any time.

“Content” may be purchased with real money, granted by Cloud Joy Games, or earned during gameplay, but has no cash value in itself. “Game Currency” is entirely non-transferable and has no actual value.

To purchase “Content”, you may not use instruments of real-world value other than money, goods, or other items provided by Cloud Joy Games or any other party that have monetary value. You may use “Content” only in the “Game” in accordance with the rules of the “Game”. If the rules of the “Game” allow you to use “Content” (especially “Game Currency”) to purchase other “Content” in the “Game” (especially items or upgrades), such purchases do not constitute real-life transactions. Cloud Joy Games is not responsible for any such transactions conducted outside the “Cloud Joy Games Services”.

You agree not to sell, trade, purchase, or transfer “Content” to or from any person or entity other than Cloud Joy Games (including but not limited to other “Users” or third parties), or otherwise exchange “Content” for real money or physical goods by any other means.

Any “Content” that you purchase, earn during gameplay, or that is granted by Cloud Joy Games is licensed to you on a limited, personal, non-transferable, and non-sublicensable basis, and may be used only in the “Game” for non-commercial purposes.

You may purchase “Content” for a fee using the methods provided in the “App”, including payment by credit card, electronic bank transfer, or through Apple, Google, or other similar accounts. To make a payment, you may be required to accept the terms and conditions applicable to the selected payment method, including any applicable additional payment handling fees. Cloud Joy Games is not a payment service provider and is not responsible for any issues relating to purchase transactions that may arise from the services of payment service providers. For further information about payments, please refer to §15.

Cloud Joy Games is not responsible if you exhaust, lose, damage, delete, or improperly use “Content”, or if external factors unrelated to Cloud Joy Games cause interruption of the game or early termination of the “Game”, resulting in “Content” being exhausted, lost, damaged, deleted, or improperly used.

§14[Purchase of “Content”]

You may create an “Order” for “Content” 24 hours a day, subject to technical availability and system maintenance periods.

You must select the type and quantity of “Content” to be purchased and the payment method to be used (hereinafter referred to as an “Order”). An “Order” is your offer for the specific “Content” provided by us.

Before creating an “Order”, you may review the total amount payable, including value-added tax and other applicable taxes and fees.

You must pay the amount of the “Order” in advance, and you confirm your obligation to pay when clicking the “order and pay” button (or a button with the same function).

You may modify the “Order” before confirming it by pressing the “order and pay” button (or another equivalent button).

After you select a payment method and select the appropriate button confirming that you must assume a payment obligation, the system may redirect you to the website of an external payment service provider to make the payment.

If the offer is accepted, Cloud Joy Games will send a confirmation email to your email address and/or confirm the transaction through communication tools in the “Game”.

When you receive the “Content” in your “Account”, Cloud Joy Games has fulfilled its obligation to provide the “Content”.

After receiving the “Content”, you may use the “Content” in the “Game” at any time until the date on which the “Agreement” for provision of the “Game” or “Content” is terminated or rescinded (hereinafter referred to as the “Validity Period”).

§15[Payment]

You hereby declare that you are authorised to use the selected payment method and that all payment information you provide is accurate and true. You are responsible for any incorrect or false information provided.

For purchase transactions made using the selected payment method, you authorise Cloud Joy Games and/or the applicable payment service provider to charge you the relevant fees. You must promptly update all payment information to ensure that such information is current, complete, and accurate (for example, changes to billing address, credit card number, or credit card expiry date). In addition, if your credit card is cancelled, lost, or stolen, or if your payment method is subject to security concerns, you must immediately notify us and the relevant payment service provider.

Any applicable fees shall be paid in advance and, after performance of the “Agreement” for the specific “Cloud Joy Games Service” has been completed, such fees are in principle non-refundable, whether in whole or in part. In particular, once Cloud Joy Games provides “Content” to you in accordance with these Terms of Service, payment for the “Content” is in principle final and non-refundable.

As each payment method available to you requires a personal transfer authorisation assigned to you, unless we become aware of a suspected or actual security issue before the transfer, we will treat each payment operation originating from your “Account” or mobile device as having been made by you.

If you purchase “Content” through a “Third-Party Platform” (for example, the App Store or Google Play), the transaction is processed by the third party and is governed by its terms and conditions. Accordingly, we have no control over how the transaction is conducted, and we may receive only very limited information relating to your purchase transaction. We may be unable to meet your expectations in providing you with spending record information. Any disputes or issues relating to the transaction must be resolved directly with the relevant third-party platform.

§16[Updates and Modifications]

Cloud Joy Games may correct, update, or modify the “Cloud Joy Games Services” (hereinafter referred to as “Updates”). Specifically, operations that Cloud Joy Games may carry out during “Updates” include but are not limited to: modifying the “Cloud Joy Games Services” or “Content”, improving the security of the “Cloud Joy Games Services” or “Content”, changing or improving the availability and other attributes of the “Cloud Joy Games Services” or “Content”, including making modifications as necessary to ensure that the “Cloud Joy Games Services” comply with these Terms of Service. We reserve the right to temporarily suspend provision of the “Cloud Joy Games Services” during “Updates”, but will use our best efforts to restore operation of the “Cloud Joy Games Services” as soon as possible.

Cloud Joy Games reserves the right to discontinue the provision of a specific “Cloud Joy Games Service” based on factors relating to taxation, economic efficiency, or development strategy. In such cases, Cloud Joy Games shall endeavour to inform you of such decision in a timely manner and shall terminate the provision of the “Cloud Joy Games Service” in accordance with the procedure described in §25.

Cloud Joy Games shall inform you about “Updates” in accordance with the provisions set out in these Terms of Service (including the provisions of §29).

You understand that you may be required to perform certain “Updates” to ensure that the “Cloud Joy Games Services” function properly. In such cases, you must install the “Updates” as necessary in accordance with the instructions and recommendations provided by Cloud Joy Games. If you have been informed that Cloud Joy Games provides an “Update” and of the consequences of not installing the “Update”, but you do not install the “Update” in accordance with the “Agreement” within a reasonable time, resulting in the “Cloud Joy Games Services” failing to conform to the “Agreement”, Cloud Joy Games shall not be responsible.

The “Cloud Joy Games Services” provided to you are in principle the latest version at the time the “Agreement” is concluded. However, the “Cloud Joy Games Services” are continuously improved, particularly to meet the expectations of “Users”. Therefore, Cloud Joy Games reserves the right to provide you with new beta versions of the “Cloud Joy Games Services”, provided that you have been informed in advance.

Cloud Joy Games has the right at any time, through “Updates”, to manage, adjust, modify, control, or delete “Content”. Such “Updates” apply to “Content” available for purchase in the “Game” and/or “Content” that you have purchased and that remains within the “Validity Period” (as defined in §14(9)). Cloud Joy Games shall inform you in a timely manner of such material changes (especially the content and timing of the changes) 14 days before making the changes, so that you have an opportunity to use “Content” that has been purchased but not yet actually used. Cloud Joy Games may decide at its sole discretion whether to provide refunds or replacements for “Content” that is managed, adjusted, modified, controlled, or deleted, with replacement to be made by granting you new or different “Content” in the same “Game”. If the information requirements above have been satisfied, then after the date of the “Update”, Cloud Joy Games shall not be required to provide refunds for “Content” that has been managed, adjusted, modified, controlled, or deleted. However, you retain the termination right described in §16(7) of these Terms of Service.

You understand that Cloud Joy Games has the right to carry out “Updates” and that the “Cloud Joy Games Services” are products that may change over time (for example, changes in concept, art, or business direction in order to balance entertainment, economic efficiency, and other aspects). Accordingly, we may add, delete, modify, or replace certain “Cloud Joy Games Services”. If changes planned by Cloud Joy Games may have a material adverse effect on your access to or use of the “Cloud Joy Games Services”, Cloud Joy Games shall inform you. The relevant information shall be sent to you in a timely manner. In the event of such changes, you may terminate the “Agreement” without further notice within 30 days after the change or after Cloud Joy Games informs you of the change. The foregoing right shall not apply if Cloud Joy Games entitles you to retain the “Cloud Joy Games Services” affected by the change, free of charge and as they are, in a form conforming to the “Agreement”.

§17[“User Content”]

“User Content” means any materials (such as communications, images, sounds, and all data and information) uploaded, shared, or posted by you through the Cloud Joy Games Services, or any materials uploaded, shared, or posted by other users through the Cloud Joy Games Services.

Cloud Joy Games is not responsible for the conduct of users who post User Content, and has no obligation to conduct ongoing supervision of User Content to check for illegal content or improper conduct.

Your use of the Cloud Joy Games Services is at your own risk. By using the Cloud Joy Games Services, you may be exposed to illegal content from other users.

§18[Cloud Joy Games Licence]

You hereby grant Cloud Joy Games an irrevocable, perpetual, transferable, royalty-free, worldwide sublicensable and assignable licence and rights to actually copy, reproduce, adjust, adapt, modify, create, commercialise, publish, distribute, sell, license, sublicense, transfer, rent, transmit, publicly display, publicly perform, broadcast, communicate to the public by telecommunication devices, screen, perform, input online and use your “User Content” and all derivative works in any manner, to create derivative works from and provide electronic access to such content, and to store such content on computers.

Whether or not your “User Content” has been modified, you may not exercise the right to have the “User Content” marked with your name or nickname and/or the moral rights you have in the “User Content”.

Cloud Joy Games does not claim ownership of your “User Content”, and nothing in these Terms of Service limits your rights to use the “User Content”. Cloud Joy Games has no obligation to monitor or enforce the intellectual property rights you have in the “User Content”.

§19[User Interactions]

You are solely responsible for your interactions with other “Users” or other parties through the “Cloud Joy Games Services”. Cloud Joy Games reserves the right to become involved in potential disputes, but has no obligation to do so. In addition, Cloud Joy Games assumes no implied or express responsibility to monitor disputes between “Users”.

§20[Illegal Content]

Illegal content means any content (such as communications, images, sounds, and all materials, data, and information) that, in itself or by reason of its connection with an act, does not comply with local laws, these Terms of Service, or the Cloud Joy Games Code of Conduct.

Cloud Joy Games prohibits the transmission, sharing, or posting of illegal content in any of its services.

Content deemed not to comply with the Terms of Service includes but is not limited to:

Acts of terrorism or acts of extreme violence;

Threats involving the use of force;

Hate speech, including content that is offensive, sexist, racist, hateful, incites hatred against individuals or groups based on characteristics such as age, disability, nationality, ethnicity, gender identity, or sexual orientation, or is discriminatory in any way;

Content relating to illegal goods or activities;

Acts that infringe intellectual property rights;

Vulgar, obscene, degrading, or objectifying content, or content that encourages or facilitates sexual activity in exchange for compensation (including sexual exploitation of minors) or is sexual in nature;

Fraudulent activities, including but not limited to the use, promotion, or participation (directly or indirectly) in the use of cheats, exploits, bots, hacks, mods, or any unauthorised third-party software designed to modify the Cloud Joy Games Services;

Spam, including unsolicited commercial information;

Other harmful, immoral, or socially non-compliant content.

§21[Reporting, Monitoring, and Combating Illegal Content]

We may discover illegal content ourselves or through user reports.

If you notice content that may be considered illegal content, you may report it through the in-game button or through the form provided on the Website.

If a report contains the electronic contact details of the user submitting the report, Cloud Joy Games will send an acknowledgement of receipt to that user.

If it is determined that a user has submitted, shared, or published illegal content, Cloud Joy Games has the right to issue a warning to that user or impose other sanctions, including removing the illegal content, revoking the right to use selected or all Cloud Joy Games Services, and suspending or terminating that user’s Account in accordance with §25. Cloud Joy Games will inform that user of the actions taken in respect of their breach of the rules or the provisions of the Terms, the reasons for those actions, and the appeal procedure referred to in §22 of these Terms.

Cloud Joy Games will promptly notify the user who made the report of its decision regarding the reported content, while providing information on how to appeal that decision.

Cloud Joy Games does not undertake, and will not conduct, continuous monitoring of User Content shared within the Cloud Joy Games Services.

If illegal content is found in the Cloud Joy Games Services provided, Cloud Joy Games has the right to remove the illegal content and may issue a warning or impose other sanctions, including revoking the right to use selected or all Cloud Joy Games Services and suspending or terminating the user’s Account in accordance with §25.

In jurisdictions where consent or notice is required in order to monitor or record User Content communications, by accepting this Agreement and using the Cloud Joy Games Services, the user consents to such monitoring or recording, or acknowledges that they have been informed of it.

§22[Appeal Procedure for Decisions on Illegal Content]

If a user disagrees with a decision concerning a report of illegal content, the user has the right to lodge an appeal (“Appeal”) using the form provided on the Website within six months from the date on which they were informed of the decision.

The Appeal shall include a detailed description of the issue, the contact information of the person submitting the Appeal, and any relevant evidence or materials.

After receiving an Appeal, Cloud Joy Games will immediately acknowledge receipt by electronic means.

A decision on the Appeal will be made within 14 days after receipt.

In its decision, Cloud Joy Games may choose to:

uphold its current position;

request additional information from the appellant;

partially overturn the previous decision;

fully overturn the previous decision;

After reviewing the Appeal, Cloud Joy Games will inform the appellant of its decision and the reasons for it, and will provide information regarding the possibility of out-of-court dispute resolution as described in §23 of the Terms and Conditions.

§23[Out-of-Court Dispute Resolution]

If dissatisfied with a decision made by Cloud Joy Games in the internal appeal procedure described in §22 of these Terms, the user has the right to use an out-of-court dispute resolution procedure.

A decision made by a certified out-of-court dispute resolution body shall not be binding on Cloud Joy Games.

If the out-of-court dispute resolution body rules in favour of the user, Cloud Joy Games will bear all fees charged by the dispute resolution body and reimburse the user for any other reasonable costs incurred as a result of the dispute resolution.

If the out-of-court dispute resolution body rules in favour of Cloud Joy Games and also finds that the user acted in bad faith, the user will be required to reimburse Cloud Joy Games for all fees and other expenses incurred or to be incurred by Cloud Joy Games as a result of the dispute resolution.

The provisions of this paragraph do not affect the user’s right to challenge Cloud Joy Games’ decision in court under applicable law at any stage of the dispute resolution process.

§24[User Termination of Use of the “Cloud Joy Games Services”]

You may terminate your use of the “Cloud Joy Games Services” at any time at your discretion, and such decision will take effect immediately.

To terminate your use of the “Cloud Joy Games Services”, please contact Cloud Joy Games by sending a message through the “Support” section of the “Website” or the “Help” section of the “Account”. If you provide such information to Cloud Joy Games through the foregoing means, this means that you choose to terminate the “Agreement” and to cease access to the “Account” services and related “Cloud Joy Games Services” provided by Cloud Joy Games.

After termination of the “Cloud Joy Games Services”, Cloud Joy Games shall delete the “Account”. However, you understand that after deleting the “Account”, Cloud Joy Games may still process your personal data in accordance with the terms and purposes stated in the Privacy Policy, in particular for asserting claims, defending against any claims, or fulfilling Cloud Joy Games’ legal obligations.

§25[Cloud Joy Games’ Suspension or Termination of Provision of the “Cloud Joy Games Services”]

Cloud Joy Games may terminate the “Agreement” concluded with you for the following material reasons, upon giving you 14 days’ prior notice:

changes in laws that regulate or affect the rights and obligations between Cloud Joy Games and you, in particular regarding the provision of digital content and services and the provision of services by electronic means as described in these Terms of Service; changes in the interpretation of such provision caused by court rulings, judgments, recommendations, or regulations of relevant competent authorities or bodies; and changes in laws affecting the relationship between you and Cloud Joy Games;

changes in the scope and manner of provision of the “Cloud Joy Games Services”, or changes in the scope of the “Cloud Joy Games Services” due to technical or technological factors;

changes in the scope of provision of the “Cloud Joy Games Services” caused by Cloud Joy Games launching new “Content” or terminating existing “Content”;

discontinuation of a specific “Game”, “Content”, or any other “Cloud Joy Games Services” due to tax, economic efficiency, or Cloud Joy Games development strategy factors;

amendments to contracts or terms of service of Cloud Joy Games’ partners resulting in changes to the manner of provision of the “Cloud Joy Games Services”;

you have been inactive in a specific “Game” for at least one year.

Cloud Joy Games may suspend the “Account” if it considers that any of the following circumstances exist:

you breach these Terms of Service, in particular the use restrictions or laws described in §3, §11, §17, and §20, when using the “Cloud Joy Games Services”, or such breach of the foregoing use restrictions or laws occurs as a result of your use of the “Cloud Joy Games Services”;

you intentionally engage in improper conduct that causes harm to other “Users”, third parties, or Cloud Joy Games. The suspension period shall be limited to the time necessary to determine the suspected violation. During this period, the “User” will be informed of the reason for the suspension and the expected duration.

Cloud Joy Games may suspend the “Account” for such period as necessary to determine the cause of the foregoing circumstances, but for no longer than 14 days.

Cloud Joy Games may block the “Account” and terminate the “Agreement” for the following material reasons, upon giving you 14 days’ prior notice:

you breach these Terms of Service, in particular the restrictions relating to the “Cloud Joy Games Services” described in §3, §11, §17, and §20, or laws, when using the “Cloud Joy Games Services”, or such breach of these Terms of Service or laws occurs as a result of your use of the “Cloud Joy Games Services”;

you intentionally engage in improper conduct that causes harm to other “Users”, third parties, or Cloud Joy Games.

After termination of the provision of the “Cloud Joy Games Services”, you will no longer be able to access the “Account”, your user name and image in the “Cloud Joy Games Services”, or any benefits, entitlements, or items obtained or purchased by you when using the related “Cloud Joy Games Services”, including “Content”. Cloud Joy Games is not obliged to provide you with compensation for such losses or consequences.

All decisions of Cloud Joy Games concerning the implementation of sanctions described in this Article will be made after verification by an authorised entity designated by Cloud Joy Games. The “User” will be informed of the decision, the reasons, and the applicable appeal procedure.

When assessing whether to impose a specific sanction on a user, including suspension or deletion of the user’s Account, Cloud Joy Games will consider the following factors according to the nature of the violation:

the absolute number of items of manifestly illegal content or manifestly unfounded reports or appeals submitted or made within a given period;

the proportion of those numbers relative to the total number of items of information or reports submitted or made during the same period;

the seriousness of the abuse, including the nature of the illegal content and its consequences;

the user’s intent, if it can be determined;

the extent of the breach of these Terms, in particular with respect to the Cloud Joy Games Services restrictions set out in §3, §11, §17, and §20, or the user’s breach of applicable laws when using the Cloud Joy Games Services.

Cloud Joy Games reserves the right to refuse to provide Cloud Joy Games Services to any user whose Agreement has been terminated by Cloud Joy Games due to the user’s conduct.

§26[Liability]

You are responsible for ensuring that the digital environment used to use the “Cloud Joy Games Services” meets the technical requirements defined in the “Agreement” or elsewhere, such as in notices, the “Account”, or the relevant “Cloud Joy Games Services”.

If the “Cloud Joy Games Services” are unavailable or do not function properly, you must cooperate with Cloud Joy Games to determine whether the cause lies in your digital environment, such as your device or network connection. Cloud Joy Games undertakes to use technical measures that have the least impact on “Users” to resolve the issue, and to respect your rights and privacy in accordance with locally applicable laws and regulations.

Cloud Joy Games shall use its best efforts to ensure that the “Cloud Joy Games Services” conform to the “Agreement”. You expressly understand that if Cloud Joy Games is unable to provide the “Cloud Joy Games Services” in accordance with the “Agreement”, or if doing so would generate excessive costs, Cloud Joy Games may refuse to provide the “Cloud Joy Games Services” in accordance with the “Agreement”.

Without prejudice to the rights granted to you by applicable law, other than the liabilities described in the “Agreement”, Cloud Joy Games provides no (additional) express or implied warranties, including any warranty that you may access or use the “Cloud Joy Games Services” at any time and from any place, or that the “Cloud Joy Games Services” will be free of any errors and will continue to operate properly, although we will use our best efforts to achieve this. However, this does not limit or exclude any mandatory rights you enjoy under applicable law, including applicable laws regarding the conformity of digital content and services.

The provisions in these Terms of Service do not exclude or limit any rights granted to you by applicable law.

§27[Right of Withdrawal]

You have the right to withdraw from the “Agreement” for any reason within 14 days after conclusion of the “Agreement” (applicable to “Agreements” relating to the handling of the “Account”, the provision of “Games”, and the provision of other “Cloud Joy Games Services”), without paying any fees other than those prescribed by law.

To exercise the right of withdrawal from the “Agreement”, please submit a withdrawal notice to Cloud Joy Games. You may submit the withdrawal notice by completing the “Agreement” withdrawal form in Appendix 1 to these Terms of Service. Even if you do so, you still have the right to submit any other binding notice stating your decision to withdraw.

The withdrawal notice shall contain the information necessary to identify you and the “Agreement”: at a minimum, the user name, user ID (UID), email address, type of “Agreement”, and subject matter of the “Agreement” must be provided.

Please send the withdrawal notice through the “Support” section of the “Website” or the “Help” section of the “User Account”.

The deadline for submitting the withdrawal notice is met as long as the notice is sent before the “Agreement” withdrawal period expires.

If you withdraw from the “Agreement”, the “Agreement” shall be deemed not to have been concluded. Cloud Joy Games shall refund all payments made by you within 14 days from the day on which it becomes aware of your decision to withdraw from the “Agreement”, without undue delay. Unless you expressly agree to a refund by another method and that refund method does not cause you to pay any additional fees, the relevant amounts shall be refunded to you through the payment method you originally selected. If you withdraw from the “Agreement” because the “Cloud Joy Games Services” do not conform to the “Agreement”, Cloud Joy Games shall refund only the corresponding portion of the amounts paid for the “Cloud Joy Games Services” that do not conform to the “Agreement” and for the “Cloud Joy Games Services” that no longer need to be provided after withdrawal from the “Agreement”.

If, before the commencement of provision of the “Cloud Joy Games Services”, you have been informed that you will have no right to withdraw from the “Agreement” once you begin using the “Cloud Joy Games Services”, you may consent to our full provision of the “Cloud Joy Games Services” immediately after conclusion of the “Agreement”. If you agree to this, you will have no right to withdraw from the “Agreement” because Cloud Joy Games has provided the specific services.

Cloud Joy Games hereby states that if you access the “Cloud Joy Games Services” through a “Third-Party Platform”, such as downloading a mobile application from the App Store or Google Play, such activities and your right of withdrawal from the “Application” access agreement, if applicable, are governed by the rules of the platform owner, Apple and Google respectively.

§28[Complaints]

You may submit a complaint regarding the “Cloud Joy Games Services” described in these Terms of Service (hereinafter referred to as a “Complaint”). If you submit a Complaint concerning a situation in which the “Cloud Joy Games Services” do not conform to the “Agreement”, we will review the “Complaint” in accordance with the applicable provisions, including the provisions of §28(2) to §28(7) of these Terms of Service.

If it is clear from Cloud Joy Games’ statement or the relevant circumstances that Cloud Joy Games will not provide the “Content” or “Services”, for example, if Cloud Joy Games has not provided the “Content” or “Services” within 14 days and has not contacted you, you may withdraw from the “Agreement” without additionally requesting Cloud Joy Games to provide the “Content” or “Services”. If you have made arrangements with Cloud Joy Games, or if it is clear from the relevant circumstances that Cloud Joy Games will not provide the “Content” or “Services” within a time limit that is essential to you, you also have the right to withdraw from the “Agreement”.

If the “Cloud Joy Games Services” do not conform to the “Agreement”, you may, by way of a “Complaint”, request that Cloud Joy Games provide the “Cloud Joy Games Services” in accordance with the “Agreement”. If the request is justified, Cloud Joy Games shall provide the “Cloud Joy Games Services” in accordance with the “Agreement” within a reasonable period of time, usually 14 days, after you have properly informed Cloud Joy Games of such non-conformity. Cloud Joy Games shall be responsible for handling the relevant process and providing the “Cloud Joy Games Services” in accordance with the “Agreement” without causing you excessive inconvenience. However, Cloud Joy Games may request your cooperation in this regard, in particular by providing Cloud Joy Games with the necessary information requested by Cloud Joy Games, especially the information described in §28(9). In the course of providing the “Cloud Joy Games Services” in accordance with the “Agreement”, Cloud Joy Games shall take into account the nature and intended use of the “Cloud Joy Games Services”.

If Cloud Joy Games fails to provide the “Cloud Joy Games Services” in accordance with the “Agreement”, or fails to perform the obligations described in §28(3) above, you may request a price reduction or withdraw from the “Agreement” relating to that “Cloud Joy Games Service”. You also have the foregoing rights in the following circumstances:

provision of the “Cloud Joy Games Services” in accordance with the “Agreement” is impossible or would generate excessive costs. When assessing whether excessive costs would be generated, Cloud Joy Games will take into account the various circumstances of the individual case, in particular the extent of the impact of the non-conformity with the “Agreement” and the value of the relevant non-conforming “Cloud Joy Games Services”.

after taking into account the nature and intended use of the “Cloud Joy Games Services”, Cloud Joy Games has not provided the relevant “Cloud Joy Games Services” in accordance with the “Agreement” as provided in §23(3) above, namely by taking action within a reasonable period of time after you informed Cloud Joy Games of the non-conformity with the “Agreement” and without causing you excessive inconvenience.

although Cloud Joy Games has attempted to provide the “Cloud Joy Games Services” in accordance with the “Agreement”, the “Cloud Joy Games Services” still remain non-conforming.

the non-conformity of the “Cloud Joy Games Services” with the “Agreement” is significant enough to justify a request for a price reduction or withdrawal from the “Agreement” without exercising the right to require Cloud Joy Games to provide the “Cloud Joy Games Services” in accordance with the “Agreement” as provided in §28(3).

it is clear from Cloud Joy Games’ statement or the relevant circumstances that Cloud Joy Games will not provide the “Cloud Joy Games Services” in accordance with the “Agreement” as provided in §28(3).

If you request a price reduction, it must bear the same proportion to the price arising from the “Agreement” as the value of the non-conforming “Cloud Joy Games Services” bears to the value of conforming “Cloud Joy Games Services”. If we provide only part of the “Cloud Joy Games Services”, or provide the “Cloud Joy Games Services” on a continuous basis, the amount of the price reduction shall also take into account the length of time during which the “Cloud Joy Games Services” were non-conforming.

If we provide the “Cloud Joy Games Services” because you have paid the relevant amounts, and the non-conformity with the “Agreement” is minor, you may not withdraw from the “Agreement” relating to the “Cloud Joy Games Services”.

If you withdraw from the “Agreement”, Cloud Joy Games may prohibit you from further using the “Cloud Joy Games Services”, in particular by blocking your access to the “Cloud Joy Games Services” or the “Account”.

To submit an “Appeal”, please send a message through the “Support” section of the “Website” or the “Help” section of the “User Account”.

An “Appeal” shall include at least the user name, user ID (UID), email address, the subject of the “Appeal”, information on the relevant circumstances demonstrating the reasonableness of the “Appeal”, and the resolution expected by the “User”.

Cloud Joy Games must review and respond to the “Appeal” as soon as possible within 14 days from the date on which the “Appeal” is submitted.

If you have provided an email address, Cloud Joy Games will send the response to the “Appeal” to that address. If no email address has been provided, Cloud Joy Games shall contact you by other means, in particular through the “Account”.

If the “User” is not satisfied with our response to or resolution of the “Complaint”, the “User” may bring proceedings before a court of competent jurisdiction. The “User” retains all rights to seek judicial remedies under applicable law.

§29[Notices]

Unless otherwise stated in these Terms of Service, Cloud Joy Games and you shall communicate through electronic communication channels (including the provision of any notices, information and statements).

You may contact Cloud Joy Games through the “Support” section of the “Website” or the “Help” section of the “Account”.

Cloud Joy Games may contact you through your email address (if provided) and the communication channels available in the “Account”, and by accepting these Terms of Service you acknowledge and agree that we may do so.

Cloud Joy Games will provide you with legally required information by sending an email to the email address linked to the “Account”, or through the communication channels available in the “Account”. If Cloud Joy Games has not obtained your email address (in particular where you use the “Cloud Joy Games Services” through a “Third-Party Platform”), your email address is invalid or has been cancelled, or Cloud Joy Games is unable to contact you by email for any other reason, Cloud Joy Games shall use the communication channels available in the “Account”.

§30[Technical Support]

Cloud Joy Games provides customer service to “Users”.

For customer service, you may contact Cloud Joy Games through the “Support” section of the “Website” or the “Help” section of the “Account”.

Customer service is free of charge and is available regardless of whether an “Account” has been registered.

You may submit requests concerning any aspect related to the provision of “Cloud Joy Games Services” by Cloud Joy Games, including in particular but not limited to:

inability to access the “Game”, “Account” or any other “Cloud Joy Games Services”;

technical issues in the “Game” or “Account”;

payment transfer issues.

We will endeavour to respond as soon as possible. In most cases, we aim to respond within 14 days after receiving your enquiry, especially in matters involving complaints or formal requests concerning non-conformity.

§31[Severability]

You and Cloud Joy Games agree that, if any provision of these Terms of Service is held by a court of competent jurisdiction to be unlawful or unenforceable in whole or in part, then, within the jurisdiction of such court, that provision shall be unenforceable only to the extent that it has been held to be invalid or unenforceable, without affecting its validity or enforceability in other jurisdictions or affecting the other provisions of these Terms of Service, which shall remain in full force and effect.

§32[No Waiver]

Any failure by Cloud Joy Games to require or enforce your strict compliance with any provision of these Terms of Service, or to exercise any right granted under these Terms of Service, shall not be construed as Cloud Joy Games waiving or relinquishing its right subsequently to require or invoke such provision.

Unless otherwise expressly and specifically provided in these Terms of Service, any representation, statement, consent, waiver of rights or other omission by Cloud Joy Games shall not be deemed to amend these Terms of Service and shall have no legal effect, unless there is a relevant written record containing the handwritten signatures of both you and a duly appointed executive officer of Cloud Joy Games.

§33[Force Majeure]

Neither Cloud Joy Games nor you shall be liable where obligations under these Terms of Service are not performed within the prescribed time limit or cannot be performed due to factors beyond the control of Cloud Joy Games or you (including, without limitation, inability to perform the “Agreement” due to unexpected circumstances or factors beyond the control of Cloud Joy Games or you). Such factors include acts of God, war, acts of terrorism, riots, injunctions, acts of civil or military authorities, fire, flood, accidents, strikes, or shortages of transportation facilities, fuel, energy, labour or raw materials.

§34[User Contact Point]

If you have any questions or concerns regarding the Cloud Joy Games Services or this Agreement, please contact the Cloud Joy Games support team through the “Support”, “Help”, “Contact” or similar option on the Website or in the User Account and submit your enquiry. The Cloud Joy Games support team is the sole contact point for communications with Cloud Joy Games.

§35[Reporting and Transparency]

Cloud Joy Games is committed to maintaining transparency in its moderation of User Content and regularly publishes reports on these activities.

Cloud Joy Games adopts clear and transparent procedures for moderating User Content, including removing, restricting the visibility of, and blocking User Content that does not comply with any local laws, this Agreement or the Cloud Joy Games Code of Conduct.

Decisions regarding the moderation of User Content are based on clear guidelines and standards, which are described in detail in this Agreement.

Cloud Joy Games undertakes to publish annual reports on the moderation of User Content. These reports will be made available through the Website and will specifically include:

the number of reports received concerning illegal content;

the number of orders received from Member State authorities;

the number of reports from trusted flaggers;

all actions taken in response to reports, with actions categorised according to whether they were based on legal requirements or the Agreement, the number of reports processed using automated means, and the median time taken to take action.

§36[Amendments]

Cloud Joy Games reserves the right to amend these Terms of Service at any time on the basis of at least one of the following valid reasons:

changes in laws that regulate or affect the rights and obligations of Cloud Joy Games and you toward each other (in particular with respect to the provision of digital content and services, and the provision of services by electronic means as described in these Terms of Service), changes in the interpretation of such provision arising from court rulings, judgments, recommendations, or regulations of relevant competent authorities or bodies, and changes in laws affecting the relationship between you and Cloud Joy Games;

changes in the manner of provision of the “Cloud Joy Games Services” due to technical or technological factors;

changes in the scope or manner of provision of the “Cloud Joy Games Services” due to the launch of new “Cloud Joy Games Services” or the termination of existing “Cloud Joy Games Services”;

changes in the manner of provision of the “Services” resulting from amendments to the contracts or terms of service of Cloud Joy Games’ partners;

the elimination of uncertainties and ambiguities in the interpretation of the contents of the Terms of Service;

changes to, development of, or deletion of functions in a “Cloud Joy Games Service”, or the need to adjust these Terms of Service in line with updates to such functions;

the further launch of “Cloud Joy Games Services” on new platforms;

changes to the corporate details of Cloud Joy Games referred to in these Terms of Service.

If these Terms of Service are amended, Cloud Joy Games shall inform you and make the amended Terms of Service available to you by publishing them on the “Website”; if you have an “Account”, Cloud Joy Games shall also send the amended Terms of Service to the email address linked to the “Account” or make them available to you in the “Account”. If Cloud Joy Games has not obtained your email address (in particular where the “User” uses the “Cloud Joy Games Services” through a “Third-Party Platform”), your email address is invalid or has been cancelled, or Cloud Joy Games is unable to contact you by email for any other reason, Cloud Joy Games shall provide the amended Terms of Service to you through the “User Account”.

Amendments to the Terms of Service shall take effect 7 days after the “User” receives notice of the amendments. If you do not accept the amended Terms of Service, you have the right to terminate the “Agreement” before the amended Terms of Service take effect, without further notice, through the “Support” section of the “Website” or the “Help” section of the “Account”.

If we are required, pursuant to law, a court judgment or a similar act of a relevant competent authority, to amend the Terms of Service more quickly than provided in §36(3) above, Cloud Joy Games shall notify you. The notice shall include the reasons why we must make the amendments so quickly and the effective date of the amendments.

§37[Miscellaneous and Governing Law]

The current version of the Terms of Service is available at: Terms of Service .

To the extent permitted by applicable law, the registered office of Cloud Joy Games shall be deemed to be the place where services are provided under these Terms of Service.

This “Agreement” shall be governed exclusively by the laws of the Hong Kong Special Administrative Region of China.

To the maximum extent possible, conflict-of-law provisions shall be excluded, and the courts of the Hong Kong Special Administrative Region of China shall have exclusive jurisdiction.

Even if any part of these Terms of Service is held to be unenforceable, this shall not affect the enforceability of the other parts of these Terms of Service.

Within the scope covered by these Terms of Service, these Terms of Service shall supersede any previous relevant arrangements of Cloud Joy Games as from the date stated herein.

「Cloud Joy Games服務」的所有相關權利、所有權或利益，以及「Cloud Joy Games服務」中的元素（包括但不限於任何「遊戲」、其概念、主題、物件、角色、角色名稱、故事、對白、流行語、圖片、動畫、音訊、音樂作品、視聽效果、操作方式、聊天內容文字轉錄稿、角色設定資訊、「遊戲」儲存資料，以及在「Cloud Joy Games服務」中或與「Cloud Joy Games服務」搭配顯示及/或使用的軟體、標誌、圖像設計元素、商標、資料庫、文字、資訊、聲明、圖片、照片、設計，及其他素材與內容、圖像、互動內容、影片與音訊內容，外加「網站」或「應用程式」的任何基礎元素，包括但不限於原始碼、目的碼，以及與「網站」或「應用程式」之運作或「內容」相關的任何文件）均受法律保護。Cloud Joy Games保留所有權利，包括但不限於「Cloud Joy Games服務」的所有智慧財產權或其他專屬權利。

「Cloud Joy Games服務」提及的其他公司、產品或服務名稱可能為其各自擁有者的商標或服務商標。

本《服務條款》的任何內容皆不應理解為授予您以下項目的擁有權：「Cloud Joy Games服務」或當中元素的商標、服務商標、商號、版權、其他智慧財產權或其他權利。您只能依本《服務條款》明確允許的方式使用「Cloud Joy Games服務」。若要進行其他「Cloud Joy Games服務」存取及使用行為，一律須事先獲得Cloud Joy Games的書面許可。

§2 [授權]

若您接受並持續遵守本《服務條款》，Cloud Joy Games將授予您非專屬、不可轉移、不可轉授權、可撤銷的有限授權，允許您基於自己的非商業性娛樂目的存取及使用「Cloud Joy Games服務」。您同意不會將「Cloud Joy Games服務」用於任何其他目的。此授權會在與Cloud Joy Games有關特定Cloud Joy Games服務的「協議」終止時失效。

§3 [「Cloud Joy Games服務」的使用限制]

用「Cloud Joy Games服務」時，請勿違反下列限制，否則可能會導致「帳號」和/或任何其他「Cloud Joy Games服務」（例如：遊戲、Chat）遭到停權或封鎖。Cloud Joy Games 應提前通知使用者任何預定的停權或終止，說明此類行動的原因，並提供使用者回應的機會，除非根據適用法律需要立即採取行動以防止損害或非法活動。您同意在任何情況下均不會做出下列行為：

從事、使用或參與（直接或間接）作弊行為、漏洞、自動化軟體、機器人、作弊外掛、模組，或用於修改或干擾「Cloud Joy Games服務」運作的未經授權第三方軟體。

在未獲得Cloud Joy Games明確書面許可的情況下，修改屬於「Cloud Joy Games服務」的任何檔案，或是造成這類檔案遭到修改。

對「Cloud Joy Games服務」的正常運作造成干擾或負面影響，或是在使用「Cloud Joy Games服務」時，做出可能會對其他使用者的體驗造成負面影響的行為，包括勝負交易和任何其他排名操弄行為、利用「Cloud Joy Games服務」中的錯誤取得其他玩家沒有的不公平優勢，以及刻意濫用或違反「Cloud Joy Games服務」設計的任何其他行為。

干擾用於提供或支援「服務」的電腦或伺服器或使其超載，或是協助從事這類行為。

從事、協助或參與針對「Cloud Joy Games服務」的任何種類的攻擊，包括但不限於散布病毒、阻斷服務，或是干擾「Cloud Joy Games服務」或影響任何人使用「Cloud Joy Games服務」的其他行為。

未使用Cloud Joy Games提供的使用者介面，嘗試在未經授權的情況下存取「Cloud Joy Games服務」、為他人註冊的「帳號」，或是連結至「Cloud Joy Games服務」的電腦、伺服器或網路，包括但不限於規避或修改、試圖規避或修改，或是誘導或協助他人規避或修改屬於「Cloud Joy Games服務」的任何安全機制、技術、裝置或軟體。

騷擾、虐待或傷害任何人（包括Cloud Joy Games員工和Cloud Joy Games客服代表），或是試圖從事、協助或引起這類行為。

針對用於提供「Cloud Joy Games服務」的任何基礎軟體或其他智慧財產，重建、反向工程、反編譯、拆解、解譯，或試圖得出其原始碼，或是使用Cloud Joy Games未明確允許的方法從「Cloud Joy Games服務」取得任何資訊。

向「Cloud Joy Games服務」的其他使用者索取登入資訊、其他登入憑證或個人資料。

散布垃圾內容（例如來路不明的商業資訊）。

從事商業、廣告或促銷活動，但若已與Cloud Joy Games個別達成協議則不在此限。

一再傳送相同的訊息，或極頻繁傳送許多不同的訊息（洗版）。

經常且頻繁地要求退款，或是在收到退款後繼續使用「內容」，藉此濫用第三方（例如Apple、Google）的退貨政策。

在Cloud Joy Games服務中發佈或分享非法內容。

以與其預期目的不一致的方式使用「支援」、「幫助」、「聯繫」或類似的標籤，包括製作有關非法內容的虛假報告，意圖傷害其他使用者或誤導Cloud Joy Games工作人員。

§4 [使用者]

若要成為「Cloud Joy Games服務」使用者，您必須是符合以下條件的自然人：行為目的與您的商業或職業活動無關、在註冊「帳號」時已年滿18歲或您居住地適用法律所規定的法定年齡，並擁有從事法律行為的充分能力（以下簡稱「使用者」）。

選擇接受本《服務條款》及存取「Cloud Joy Games服務」，即表示使用者確認其已年滿 18 歲或其居住地適用法律所規定的法定年齡，並擁有從事法律行為的充分能力。Cloud Joy Games保留在適用法律要求的情況下，實施額外措施以驗證使用者的年齡和法律能力的權利。

您瞭解「Cloud Joy Games服務」所含的內容可能僅適用於年滿法定年齡的「使用者」，因此會自行承擔使用「Cloud Joy Games服務」的相關責任和風險。

§5 [個人資料]

若要存取及使用「Cloud Joy Games服務」，您可能必須向Cloud Joy Games提供個人資料，Cloud Joy Games會依據《Cloud Joy Games隱私政策》（以下簡稱「隱私政策」）蒐集、使用及揭露這些資料。若要參閱《隱私政策》，請前往 https://mhfish.com/privacy/index.html。

Cloud Joy Games會依據《隱私政策》中的條款處理您的個人資料。

§6 [使用「Cloud Joy Games服務」的技術要求]

存取「Cloud Joy Games服務」需要硬體（包括搭載最新作業系統的Microsoft Windows或macOS電腦，或是Android或iOS行動裝置）、支援Cookie的網路瀏覽器，以及網路連線。具體來說，支援的瀏覽器類型包括：最新版本的Google Chrome、Mozilla Firefox、Microsoft Edge。為了確保「遊戲」和「Cloud Joy Games服務」正常運作，您可能必須安裝外掛程式，且註冊時須提供電子信箱地址。

基於各種原因（包括但不限於系統安全性、穩定性和多人遊戲互通性），Cloud Joy Games能必須自動更新或改善「Cloud Joy Games服務」，因此使用「Cloud Joy Games服務」的技術要求可能會隨時間改變。您同意進行這類為系統安全性、穩定性或互通性所必需的自動更新。使用者將會被通知任何可能影響其存取或使用「Cloud Joy Games服務」能力的重大更新或技術要求變更。

Cloud Joy Games不保證您可在自己選擇的時間或地點存取或使用「Cloud Joy Games服務」。

您可能必須為想使用的裝置安裝最新版本的作業系統，才能存取各項「Cloud Joy Games服務」，並確保特定「Cloud Joy Games服務」可正常運作。請根據裝置和相關作業系統的製造商建議安裝這類更新。

透過線上、無線或其他電信服務存取「Cloud Joy Games服務」時，您必須承擔所有相關費用，例如瀏覽網站、傳送訊息，以及使用網路供應商或行動網路業者的數據網路服務所產生的費用。

§7 [「Cloud Joy Games服務」]

根據本《服務條款》，Cloud Joy Games可為您提供以下項目：

「使用者帳號」、

「遊戲」、

「內容」、

「Chat」、

「訂閱方案」。

§8 [「協議」的締結、終止及履行]

發生以下情況時，即表示「Cloud Joy Games服務」「協議」已締結：

「帳號」、「遊戲」和「Chat｣：Cloud Joy Games向您或您的裝置提供「帳號」、「遊戲」和「Chat」；

「內容」：您建立的「訂購單」已經過確認，即您選取適當按鈕來確認產生付款義務。

Cloud Joy Games刪除「帳號」時，「帳號」、「遊戲」和「Chat」適用的「協議」即終止。

發生以下情況時，即應視為Cloud Joy Games已履行「協議」：提供「內容」：Cloud Joy Games向您提供所訂購的「內容」，讓您在遊戲中使用；

其他「Cloud Joy Games服務」：您或您的裝置存取這類「Cloud Joy Games服務」。

發生以下情況時，即應視為Cloud Joy Games已履行「協議」：

提供「內容」：Cloud Joy Games向您提供所訂購的「內容」，讓您在遊戲中使用；

其他「Cloud Joy Games服務」：您或您的裝置存取這類「Cloud Joy Games服務」。

Cloud Joy Games應在「協議」締結後隨即開始履行「協議」（提供「內容」或服務），但若您必須依「協議」付款，Cloud Joy Games應在您正確付款且Cloud Joy Games收到款項後開始履行「協議」。若為提供「內容」，這最多可能需要24小時。

如果 Cloud Joy Games 未能履行上述第 4 條所述的義務，您可以要求 Cloud Joy Games 履行其義務。在這種情況下，Cloud Joy Games 將合理努力及時履行義務，或在與您個別協商的額外時限內履行。如果 Cloud Joy Games 未能做到這一點，您有權尋求補救措施。

§9 [「帳號」]

使用 Cloud Joy Games 服務可能需要您直接在 Cloud Joy Games 服務中或在 Facebook、Google 或 Apple 等第三方平台上註冊使用者帳號（每個皆為「帳號」），如果註冊是訪問和使用 Cloud Joy Games 服務所必需的。在這種情況下，註冊的目的是為了執行協議。

若要直接註冊，請填寫電子表單並提供所要求的資料，特别是電子信箱地址。透過傳送至該電子信箱地址的驗證連結驗證地址後，系統就會建立「帳號」。

若您透過「第三方平台」註冊或存取特定「Cloud Joy Games服務」，則在您的個人資料經過驗證且您登入該平台後，系統隨即會建立「帳號」。

若要直接註冊，您必須設定使用者名稱和密碼（以下簡稱「登入資訊」）。您隨時可在「帳號」中變更使用者名稱和密碼。

您必須將「登入資訊」保密。請勿與任何人分享「帳號」或「登入資訊」，或是允許他人存取您的「帳號」或從事可能會危害您「帳號」安全的任何其他行為。若您發現或合理懷疑有安全性問題（包括但不限於「登入資訊」遺失、遭竊，或遭人在未經授權的情況下揭露），您必須立即通知Cloud Joy Games並變更您的「登入資訊」。

您不得使用任何其他「使用者」的「帳號」。

若您的帳號或登入資訊因您的緣故經他人使用，並導致您有所損失，Cloud Joy Games 概不負責。Cloud Joy Games 已實施適當措施以保障帳號的安全，您仍需負責保持您的登入資訊的機密性和安全性。

針對未經授權使用您的「帳號」的任何相關問題，您可以透過「網站」的「支援」專區或「帳號」的「協助」專區傳送電子郵件給Cloud Joy Games。

每位「使用者」在單一「服務」中一次只能有一個「帳號」，但若Cloud Joy Games同意您針對屬於「Cloud Joy Games服務」的各項「服務」使用一個共用「帳號」，則不在此限。

您不得購買、販售、租借或贈予「帳號」、使用偽造身分或偽造資訊建立「帳號」、代替您以外的人建立「帳號」，或是試圖從事上述行為。

您可在「帳號」中進行購買交易及付款。您在此聲明您可使用與「帳號」連結的付款方式。您必須遵守「帳號」適用的任何規則，包括付款與購買交易規則。

您可以在「帳號」中儲存某些資訊（尤其是與「遊戲」過程相關的資訊），以及上傳個人識別圖片（以下簡稱「頭像」）和「使用者內容」。

您瞭解並同意您不具有帳號擁有權，且與帳號相關的所有權利均為 Cloud Joy Games 所擁有。這不影響您訪問付費內容或服務的權利。若是基於安全性因素，或是為了行使其擁有權、妥善提供任何服務，或刪除違法內容，因而有必要登入及操作您的帳號，Cloud Joy Games 有權利採取這類行動。

§10 [「遊戲」]

Cloud Joy Games會向「使用者」提供「遊戲」。若要玩「遊戲」，您需要可授權您免費進行「遊戲」的「帳號」。

您無權自行更新「遊戲」或修正任何錯誤。若您發現錯誤，請立即透過第§34節所述的支援管道或其他方式向Cloud Joy Games回報。Cloud Joy Games有責任依據適用的消費者保護法確保「遊戲」的合規性，包括修正任何影響其正常運作的缺陷。

「遊戲」的詳細說明、規則和「內容」皆包含在「遊戲」中。

Cloud Joy Games保留權利，可基於稅務、經濟效益或開發策略方面的因素終止提供特定「遊戲」。在這類情況下，Cloud Joy Games應致力及時向使用者告知這類決定，並遵循第§25節所述的程序終止提供「遊戲」。若終止影響任何已購買的內容或服務，Cloud Joy Games將確保遵守適用的消費者保護法規定之使用者權利及可能的補救措施，包括在必要時提供退款或其他適當措施。

§11 [CHAT]

Chat是指作為帳號或遊戲的一部分所提供的任何區域、頁面或功能，允許使用者發送、傳輸、發佈、顯示、創建、散佈和/或查看使用者內容，以及/或與其他使用者溝通、分享或交換使用者內容。

要使用Chat，您必須擁有一個帳號。

您確認知悉Chat及其中的使用者內容可能是為公開而非私人溝通而設計。基於所提供Chat服務的性質，Cloud Joy Games無法保證Chat中傳輸的資料會受到監控或管理。因此，您理解您透過任何Chat發送、發佈、傳輸、溝通、分享或交換的任何內容可能會被其他使用者看到，因此，您不應期望此類傳輸或發佈的內容具有隱私性。

Cloud Joy Games無法保證其他使用者不會使用使用者內容。因此，您不應在Cloud Joy Games服務中發佈想要保密和/或不希望他人使用的想法或資訊。Cloud Joy Games不負責評估或使用任何使用者內容，也不承擔任何與之相關的賠償責任。

Cloud Joy Games對於在任何Chat中發佈使用者內容的使用者的行為均不負責。雖然Cloud Joy Games沒有義務進行持續管理，但一旦發現非法內容，將立即移除。

使用者可以透過第三方平台（如Facebook或X）提供的聊天室、論壇、群組等進行溝通。這些平台不屬於Cloud Joy Games服務的範圍，並受第三方平台的規定約束。

Cloud Joy Games沒有義務且不會對Chat中共用的使用者內容進行持續監控。如果發現Chat中存在非法內容，Cloud Joy Games保留向使用者發出警告或採取相應制裁的權利，包括根據第§25節的規定撤銷對選定或所有Cloud Joy Games服務的使用權限，以及暫停或刪除使用者的帳號。除非需要立即採取行動，否則Cloud Joy Games將在通知使用者並允許其作出回應後，才實施相關措施。

§12 [訂閱方案]

作為 Cloud Joy Games 服務的一部分，Cloud Joy Games可能會提供各種訂閱方案。訂閱方案是一種Cloud Joy Games服務，可以根據所選訂閱方案的條款，定期付費使用Cloud Joy Games提供的特定功能。

訂閱方案可能以免費試用期開始，在此期間使用者可以免費使用所選方案的全部功能。按照§12第6節的規定，如果使用者不希望繼續訂閱付費的訂閱方案，應在試用期結束的至少24小時之前取消訂閱。試用期結束後，將開始第一個計費週期，並根據所選訂閱方案自動向使用者的帳戶收取費用。

除非使用者在當前計費週期結束的至少24小時之前停用訂閱方案，否則訂閱方案將自動續約。訂閱方案的費用將在當前訂閱方案到期前的24小時內從使用者提供的帳戶中扣除。

如果使用者決定將訂閱方案升級到更高級別，該變更將在使用者確認更改訂閱方案的意向後立即生效。較低級別訂閱方案中尚未使用部分的費用資金將按比例退還給使用者。

使用者可以降級到較低級別的訂閱方案，該變更將在下一個計費週期開始時生效。在此之前，使用者將繼續使用變更生效前的訂閱方案。

使用者可隨時在第三方平臺帳號的設定中取消訂閱方案。在試用期內取消將不收取訂閱方案的費用。

7. 如果使用者在試用期結束後取消訂閱方案，則能夠使用訂閱方案功能直到當前計費週期結束。在此期間的費用不予退還。

Cloud Joy Games可自行決定隨時更改訂閱方案的費用。任何費用變更的生效時間不得早於通知使用者變更後的30天。任何費用變更將至少提前30天告知使用者。

使用者選擇接受訂閱方案，即表示同意立即開始訂閱服務，並聲明已被告知在服務開始後將喪失解除合約的權利。使用者承認，一旦獲得訂閱方案所涵蓋內容的使用權，即喪失解除合約的權利，且已支付的訂閱方案費用為最終付款，即使在已開始的計費週期內取消訂閱，也不得按比例退還。

§13 [「內容」]

「內容」指的是「遊戲」中提供給「使用者」的特殊選項，具體來說包括物品、升級項目和虛擬貨幣（以下簡稱「遊戲貨幣」；這些項目合稱「內容」）。「內容」可能會因「遊戲」而異。

「內容」可透過以下方式取得：a)在遊戲過程中獲得；b)由Cloud Joy Games免費給予；c)付費購買，實際費用可能會隨時間改變（增加或減少），但此類變更僅適用於未來交易，不影響已購買的「內容」。

適用費用會在「遊戲」中與相關「內容」一併顯示。費用包含所有適用稅金，尤其是加值稅。

Cloud Joy Games保留權利，可隨時變更「遊戲」中「內容」的定價。

「內容」可使用真實貨幣購買、由Cloud Joy Games給予，或在遊戲過程中獲得，但本身不具有任何現金價值。「遊戲貨幣」完全不得轉移，也不具有實際價值。

若要購買「內容」，您不得使用金錢以外的真實貨幣工具、商品，或是由Cloud Joy Games或他方提供且具有貨幣價值的其他物品。您只能在「遊戲」中依「遊戲」規則使用「內容」。若「遊戲」規則允許您使用「內容」（尤其是「遊戲貨幣」）購買「遊戲」中的其他「內容」（尤其是物品或升級項目），這類購買行為並不構成現實生活中的交易。針對在「Cloud Joy Games服務」外部進行的這類交易，Cloud Joy Games概不負責。

您同意不向Cloud Joy Games以外的任何人或實體（包括但不限於其他「使用者」或第三方）販售、交易、購買或轉移「內容」，或是透過任何其他方式以「內容」換取真實貨幣或實際商品。

您所購買、在遊戲過程中獲得，或Cloud Joy Games給予的任何「內容」，皆是以有限、個人、不得轉移且不得轉授權的方式授權給您，且只能在「遊戲」中用於非商業用途。

您可使用「應用程式」中提供的方式付費購買「內容」，包括使用信用卡、電子銀行轉帳，或是透過Apple、Google或其他類似帳號付款。若要進行付款，您可能必須接受所選付款方式適用的條款及細則，包括適用的額外付款手續費。Cloud Joy Games並非付款服務供應商，針對付款服務供應商的服務可能出現的任何與購買交易相關的問題，Cloud Joy Games概不負責。若要進一步瞭解付款事宜，請參閱第§15節。

若您用盡、遺失、損壞、刪除或以不當方式使用「內容」，或是因與Cloud Joy Games無關的外部因素導致遊戲受到干擾或「遊戲」提前終止，並造成「內容」用盡、遺失、損壞、刪除或以不當方式使用，Cloud Joy Games概不負責。

§14 [購買「內容」]

您24小時全天候都可建立「內容」的「訂購單」，但須視技術可用性及系統維護時段而定。

您必須選取要購買的「內容」類型和數量，以及要使用的付款方式（以下簡稱「訂購單」）。「訂購單」是您針對我們提供的特定「內容」給予的報價。

建立「訂購單」前，您可以查看需支付的總金額，包含加值稅及其他適用稅費。

您必須事先支付「訂購單」的金額，且在點選「訂購並付款」按鈕（或相同功能之按鈕）時即確認付款義務。

在您按下「訂購並付款」按鈕（或其他對等按鈕）進行確認前，您可以修改「訂購單」。

在您選擇付款方式並選取適當按鈕，確認您必須承擔付款義務後，系統可能會將您重新導向至外部付款服務供應商的網站來進行付款。

若接受報價，Cloud Joy Games會傳送確認電子郵件至您的電子信箱地址，並/或透過「遊戲」中的通訊工具確認交易。

當您在「帳號」中收到「內容」時，即表示Cloud Joy Games已履行「內容」提供義務。

收到「內容」後，您隨時可在「遊戲」中使用「內容」，直到「遊戲」或「內容」提供「協議」終止或廢除的日期（以下簡稱「有效期」）為止。

§15 [付款]

您在此聲明您具有所選付款方式的使用授權，且您提供的付款資訊皆正確屬實。您須對所提供的任何錯誤或不實資訊負責。

針對使用所選付款方式進行的購買交易，您授權Cloud Joy Games和/或適用的付款服務供應商向您收取相關費用。您必須及時更新所有付款資訊，確保這些資訊符合現況、完整且正確（例如變更帳單地址、信用卡號碼或信用卡到期日）。此外，若您的信用卡已取消、遺失或遭竊，或是您的付款方式有安全之虞，您必須立即通知我們和相關的付款服務供應商。

任何適用費用均應事先支付，且在特定「Cloud Joy Games服務」的「協議」履行完畢後，這些費用無論全部還是部分原則上均不得退款。尤其是當Cloud Joy Games依據本《服務條款》向您提供「內容」後，即表示「內容」付款原則上已不可改變且不得退款。

由於您可用的每個付款方式都需要指派給您的個人轉帳授權，因此除非我們在轉帳前獲知疑似或實際發生的安全性問題，否則我們會將來自您「帳號」或行動裝置的每個付款作業視為由您所進行。

若您透過「第三方平台」（例如App Store、Google Play）購買「內容」，則交易是由第三方處理，並受其條款及細則所規範。因此，我們對於交易的進行方式沒有控管權，且針對您的購買交易，我們可能只會取得極有限的相關資訊。我們可能無法滿足您的期望，為您提供消費紀錄資訊。任何與交易相關的爭議或問題，您必須直接與相關第三方平台解決。

§16 [更新與修改]

Cloud Joy Games可修正、更新或修改「Cloud Joy Games服務」（以下簡稱「更新」）。具體來說，Cloud Joy Games可能會在「更新」時進行的作業包括但不限於：修改「Cloud Joy Games服務」或「內容」、改善「Cloud Joy Games服務」或「內容」的安全性、變更或改善「Cloud Joy Games服務」或「內容」的可用性和其他屬性，包括視需要進行修改，確保「Cloud Joy Games服務」符合本《服務條款》規定。我們保留權利，可在「更新」時暫時停止提供「Cloud Joy Games服務」，但會盡力讓「Cloud Joy Games服務」盡快恢復運作。

Cloud Joy Games保留權利，可基於稅務、經濟效益或開發策略方面的因素終止提供特定「Cloud Joy Games服務」。在這類情況下，Cloud Joy Games應致力及時向您告知這類決定，並遵循第§25節所述的程序終止提供「Cloud Joy Games服務」。

Cloud Joy Games應根據本《服務條款》所載的規定（包括第§29節的規定）向您告知「更新」相關事宜。

您瞭解您可能必須進行某些「更新」，確保「Cloud Joy Games服務」可正常運作。在這類情況下，您必須視需要按照Cloud Joy Games提供的指示和建議安裝「更新」。若您已獲知Cloud Joy Games提供「更新」以及未安裝「更新」的後果，但並未在合理時間內依「協議」安裝該「更新」，導致「Cloud Joy Games服務」不符合「協議」規範，則Cloud Joy Games概不負責。

我們提供給您的「Cloud Joy Games服務」原則上是「協議」締結時的最新版本。不過，「Cloud Joy Games服務」會持續得到改進，尤其是為了滿足「使用者」的期望。因此，Cloud Joy Games保留權利，可在已事先告知您的情況下，向您提供「Cloud Joy Games服務」的新測試版本。

Cloud Joy Games隨時有權透過「更新」管理、調整、修改、控管或刪除「內容」。這類「更新」適用於「遊戲」中可供購買的「內容」，和/或您已購買且仍處於「有效期」（請見第§14(9)條的定義）的「內容」。Cloud Joy Games應在進行變更的14天前及時向您告知這類重大變更（尤其是變更內容和時間），讓您有機會使用已購買但尚未實際使用的「內容」。Cloud Joy Games可自行決定是否要針對受到管理、調整、修改、控管或刪除的「內容」提供退款或替換品，替換方式為在同一個「遊戲」中給予您新的或不同的「內容」。若已達成上述資訊要求，則在「更新」日期後，Cloud Joy Games不應針對受到管理、調整、修改、控管或刪除的「內容」提供退款。不過，您仍保有本《服務條款》第§16(7)條所述的終止權。

您瞭解Cloud Joy Games有權進行「更新」，且「Cloud Joy Games服務」是可能會隨時間改變的產品（例如為了在娛樂、經濟效益等面向之間達到平衡而改變概念、美術或業務走向），因此我們可能會新增、刪除、修改或取代某些「Cloud Joy Games服務」。若Cloud Joy Games計劃進行的變更可能會對您存取或使用「Cloud Joy Games服務」造成重大負面影響，則Cloud Joy Games應向您告知。相關資訊應及時傳送給您。若有這類變更，您可在變更後或Cloud Joy Games告知變更事宜後的30天內終止「協議」，而不另行通知。若Cloud Joy Games讓您有權以符合「協議」的形式，免費原樣保有受變更影響的「Cloud Joy Games服務」，則不適用前述權利。

§17 [「使用者內容」]

「使用者內容」是指您透過Cloud Joy Games服務上傳、分享或發佈的任何材料（如通訊、圖像、聲音以及所有數據和資訊），或其他使用者通過Cloud Joy Games服務上傳、分享或發佈的任何材料。

Cloud Joy Games對於發佈使用者內容的使用者的行為均不負責，也沒有義務對使用者內容進行持續監管以檢查是否存在非法內容或不當行為。

您使用Cloud Joy Games服務的風險由您自行承擔。透過使用Cloud Joy Games服務，您可能會接觸到來自其他使用者的非法內容。

§18 [Cloud Joy Games的授權]

您在此向Cloud Joy Games授予不可撤銷、永久、可轉移、免權利金、可在全球範圍內轉授權和轉讓的授權和權利，允許Cloud Joy Games以任何方式實際複製、重製、調整、改編、修改、製作、商業化、發布、散布、販售、授權、轉授權、轉移、租借、傳輸、公開展示、公開表演、播送、使用電信裝置向大眾說明、播映、表演、在線上輸入及使用您的「使用者內容」和所有衍生作品、針對這些內容建立衍生作品和提供電子存取權，以及將這些內容儲存在電腦上。

無論您的「使用者內容」是否有經過修改，您不得行使將「使用者內容」標上自己姓名或暱稱的權利，以及/或您針對「使用者內容」所具有的著作人格權。

Cloud Joy Games不會針對您的「使用者內容」聲明擁有權，且本《服務條款》的內容皆不會限制您所具有的「使用者內容」使用權。Cloud Joy Games沒有義務監控或落實您所具有的「使用者內容」智慧財產權。

§19 [使用者互動]

針對您透過「Cloud Joy Games服務」與其他「使用者」或他方進行的互動，您必須全權負責。Cloud Joy Games保留涉入潛在爭議的權利，但並無這類義務。此外，針對「使用者」之間的爭議，Cloud Joy Games不承擔任何默示或明示的監控責任。

§20 [非法內容]

非法內容是指任何本身或因與某項行動相關而不符合當地法律、本服務條款或Cloud Joy Games行為準則的內容（如通訊、圖像、聲音以及所有材料、數據和資訊）。

Cloud Joy Games禁止在其任何服務中傳輸、分享或發佈非法內容。

被視為不符合服務條款的內容包括但不限於：

恐怖主義行為或極端暴力行為；

涉及使用武力的威脅；

仇恨言論，包括具有冒犯性、性別歧視、種族主義、仇恨、煽動對基於年齡、殘疾、國籍、種族、性別認同或性取向等特徵的個人或群體的仇恨，或以任何方式具有歧視性的內容；

與非法商品或活動相關的內容；

侵犯智慧財產權的行為；

粗俗、淫穢、貶低、物化的內容，或鼓勵或促進以補償換取性活動（包括對未成年人的性剝削）或本質上與性相關的內容；

詐欺活動，包括但不限於使用、推廣或參與（直接或間接）使用作弊、漏洞利用、機器人、駭客、修改器或任何旨在修改Cloud Joy Games服務的未經授權的第三方軟體；

垃圾郵件，包括未經請求的商業資訊；

其他有害、不道德或不符合社會規範的內容。

§21 [舉報、監控和打擊非法內容]

我們可能自己發現或透過使用者舉報發現非法內容。

如果您注意到可能被視為非法內容的內容，可以透過遊戲內的按鈕或透過網站上提供的表格舉報。

如果舉報包含提出舉報的使用者的電子聯繫方式，Cloud Joy Games將向該使用者發送收到確認。

如果確定某個使用者提交、分享或發布了非法內容，Cloud Joy Games有權向該使用者發出警告或施加其他制裁，包括刪除非法內容、撤銷對選定或所有Cloud Joy Games服務的使用權限，以及根據§25的規定暫停或終止該使用者的帳號。Cloud Joy Games將告知該使用者針對其違反規則或條款規定所採取的行動、這些行動的原因，以及本條款§22中提到的上訴程式。

Cloud Joy Games將迅速通知做出舉報的使用者其對舉報內容的決定，同時提供如何對此決定提出上訴的資訊。

Cloud Joy Games不承諾且不會對Cloud Joy Games服務內共用的使用者內容進行持續監控。

如果發現提供的Cloud Joy Games服務中存在非法內容，Cloud Joy Games有權刪除非法內容，並可能發出警告或施加其他制裁，包括撤銷對選定或所有Cloud Joy Games服務的使用權限，以及根據§25的規定暫停或終止使用者的帳號。

在需要同意或通知才能監控或記錄使用者內容通訊的司法管轄區，接受本協議並使用Cloud Joy Games服務即表示使用者同意此類監控或記錄，或確認他們已被告知。

§22 [對非法內容決定的上訴程式]

如果不同意關於非法內容舉報的決定，使用者有權在被告知決定之日起六個月內使用網站上提供的表格提出申訴（「申訴」）。

申訴應包括問題的詳細描述、提出申訴者的聯繫資訊以及任何相關證據或材料。

收到申訴後，Cloud Joy Games將立即以電子方式確認收到。

關於申訴的決定將在收到後14天內做出。

Cloud Joy Games在決定中可能選擇：

維持當前立場；

要求申訴人提供額外資訊；

部分推翻之前的決定；

完全推翻之前的決定；

審查申訴後，Cloud Joy Games將告知申訴人其決定及理由，並提供關於條款與細則§23中所述的庭外爭議解決可能性的資訊。

§23 [庭外爭議解決]

如果對Cloud Joy Games在本條款§22所述的內部上訴程序中做出的決定不滿意，使用者有權利用庭外爭議解決程序。

經認證的庭外爭議解決機構做出的決定不對Cloud Joy Games具有約束力。

如果庭外爭議解決機構的裁定對使用者有利，Cloud Joy Games將承擔爭議解決機構收取的所有費用，並補償使用者因爭議解決而產生的任何其他合理費用。

如果庭外爭議解決機構的裁定對Cloud Joy Games有利，同時認定使用者存在惡意行為，則使用者將被要求償還Cloud Joy Games因爭議解決而產生或將產生的所有費用和其他開支。

本款的規定不影響使用者在爭議解決過程的任何階段根據適用法律在法庭上對Cloud Joy Games的決定提出質疑的權利。

§24 [使用者終止使用「Cloud Joy Games服務」]

您隨時可任意終止使用「Cloud Joy Games服務」，且這類決定會立即生效。

若要終止使用「Cloud Joy Games服務」，請透過「網站」的「支援」專區或「帳號」的「協助」專區傳送訊息，與Cloud Joy Games聯絡。若您透過上述方式向Cloud Joy Games說明這類資訊，即表示您選擇終止「協議」，停止由Cloud Joy Games提供「帳號」服務和相關「Cloud Joy Games服務」的存取權。

終止「Cloud Joy Games服務」後，Cloud Joy Games應刪除「帳號」。不過，您瞭解Cloud Joy Games在刪除「帳號」後，仍可依據《隱私政策》所述的條款和目的處理您的個人資料，尤其是用於提出聲明、針對任何聲明進行辯護，或是履行Cloud Joy Games的法律義務。

§25 [Cloud Joy Games暫停或終止提供「Cloud Joy Games服務」]

Cloud Joy Games可基於下列重要原因，在已提前14天通知您的情況下終止與您締結的「協議」：

對於Cloud Joy Games與您彼此的權利和義務（尤其是關於提供數位內容與服務，以及依據本《服務條款》所述的電子方式提供服務）做出規範或造成影響的法律有所異動、因法院裁決、判決、建議，或相關主管機關或機構的規範導致對這類提供行為的解讀有所異動，以及影響您與Cloud Joy Games之間關係的法律有所異動；

「Cloud Joy Games服務」的提供範圍和方式有所異動，或是因技術或科技因素導致「Cloud Joy Games服務」的範圍有所異動；

Cloud Joy Games推出新「內容」或終止現有「內容」，導致「Cloud Joy Games服務」的提供範圍有所異動；

特定「遊戲」、「內容」或任何其他「Cloud Joy Games服務」因稅務、經濟效益或Cloud Joy Games開發策略方面的因素而停止；

Cloud Joy Games合作對象的合約或服務條款經過修訂，導致「Cloud Joy Games服務」的提供方式有所異動；

您已至少一年未在特定「遊戲」中活動。

若認為有以下情形，Cloud Joy Games可將「帳號」停權：

您在使用「Cloud Joy Games服務」時違反本《服務條款》特別是第§3、§11、§17及§20條所述的使用限制或法律，或是因您使用「Cloud Joy Games服務」而發生違反前述使用限制或法律的情形；

您故意從事會對其他「使用者」、第三方或Cloud Joy Games造成危害的不當行為。 停權期間僅限於確定涉嫌違規行為所需的時間。在此期間，「使用者」將被告知停權原因及預期期間。

Cloud Joy Games可視需要將「帳號」停權一段時間，以便判定發生上述情形的原因，但最多不得超過14天。

Cloud Joy Games可基於下列重要原因，在已提前14天通知您的情況下封鎖「帳號」並終止「協議」：

您在使用「Cloud Joy Games服務」時違反本《服務條款》（尤其是第3、§11、§17及§20節所述的「Cloud Joy Games服務」相關限制）或法律，或是因您使用「Cloud Joy Games服務」而發生違反本《服務條款》或法律的情形；

您故意從事會對其他「使用者」、第三方或Cloud Joy Games造成危害的不當行為。

終止提供「Cloud Joy Games服務」後，您就無法存取「帳號」、您在「Cloud Joy Games服務」中的使用者名稱和形象，以及您使用相關「Cloud Joy Games服務」時所獲得或購買的任何好處、權限或物品，包括「內容」。Cloud Joy Games沒有義務針對這類損失或結果向您提供補償。

Cloud Joy Games關於實施本條例所述制裁的所有決定將在Cloud Joy Games指定的授權實體核實後做出。「使用者」將被告知決定、理由及適用的上訴程序。

在評估是否對使用者實施特定制裁（包括暫停或刪除使用者的帳號）時，Cloud Joy Games將根據違規的性質考慮以下因素：

在給定期間內提交或提出的明顯非法內容或明顯無根據的舉報或申訴的絕對數量；

這些數量相對於同期提交或提出的資訊或舉報總量的比例；

濫用的嚴重程度，包括非法內容的性質及其後果；

使用者的意圖（如果可以確定）；

違反本條款的程度，特別是關於§3、§11、§17及§20中規定的Cloud Joy Games服務限制，或使用者在使用Cloud Joy Games服務時違反適用法律的情況。

Cloud Joy Games保留拒絕向因使用者行為而被Cloud Joy Games終止協議的任何使用者提供Cloud Joy Games服務的權利。

§26 [責任]

您必須負責確保用於使用「Cloud Joy Games服務」的數位環境符合「協議」或他處（例如通知、「帳號」或相關「Cloud Joy Games服務」）中定義的技術要求。

若「Cloud Joy Games服務」無法使用或無法正常運作，您必須與Cloud Joy Games合作，確認原因是否出在您的數位環境，例如您的裝置或網路連線。Cloud Joy Games承諾將使用對「使用者」影響程度最小的技術性措施來解決問題，並依據當地適用的法律法規尊重您的權利與隱私。

Cloud Joy Games應盡力確保「Cloud Joy Games服務」符合「協議」規範。您確實瞭解，如果Cloud Joy Games無法依據「協議」提供「Cloud Joy Games服務」，或是這樣做會產生過多成本，則Cloud Joy Games可拒絕依據「協議」提供「Cloud Joy Games服務」。

在不影響適用法律所賦予您之權利的情況下，除了「協議」所述的責任，Cloud Joy Games不提供任何（額外）明示或默示擔保，包括擔保您隨時可在任何地方存取或使用「Cloud Joy Games服務」，或「Cloud Joy Games服務」不含任何錯誤並可持續正常運作（但我們會盡力做到這一點）。然而，這並不限制或排除您依據適用法律（包括關於數位內容和服務一致性的適用法律）所享有的任何強制性權利。

本《服務條款》中的條款不會排除或限制適用法律賦予您的任何權利。

§27 [解除權]

您有權在「協議」締結後的14天內，任意解除「協議」（適用於與處理「帳號」、提供「遊戲」，以及提供其他「Cloud Joy Games服務」相關的「協議」），且除了法律規定的費用以外無須支付任何其他費用。

若要行使「協議」解除權，請向Cloud Joy Games提交解除通知。您可以填寫本《服務條款》附錄1中的「協議」解除表單來提交解除通知。即使這樣做，您仍有權提交任何其他具約束力的通知，說明您的解除決定。

解除通知應包含用於識別您身分與「協議」的必要資訊：至少要提供使用者名稱、使用者ID（UID）、電子信箱地址、「協議」類型和「協議」主題。

請透過「網站」的「支援」專區或「使用者帳號」的「協助」專區傳送解除通知。

只要在「協議」解除期限前傳送通知，即未超出解除通知的提出時限。

若您解除「協議」，則視同未締結「協議」。Cloud Joy Games應在獲知您決定解除「協議」當天算起的14天內，退還您支付的所有款項，而不無故拖延。除非您明確同意透過其他方式退款，且該退款方式不會導致您須支付額外費用，否則相關款項應透過您當初選擇的付款方式退還給您。若您因「Cloud Joy Games服務」不符合「協議」規範而解除「協議」，則Cloud Joy Games只應針對不符合「協議」規範的「Cloud Joy Games服務」，以及解除「協議」後不必再提供的「Cloud Joy Games服務」，退還相對應的部分款項。

若在開始提供「Cloud Joy Games服務」前，您已獲知一旦開始使用「Cloud Joy Games服務」即無權解除「協議」，則您可同意我們在「協議」締結後隨即完整提供「Cloud Joy Games服務」。若您同意這麼做，您將無權解除「協議」，因為Cloud Joy Games已提供特定服務。

Cloud Joy Games在此聲明，若您透過「第三方平台」存取「Cloud Joy Games服務」（例如從App Store或Google Play下載行動應用程式），這類活動以及您的「應用程式」存取協議解除權（如適用）皆適用該平台擁有者（分別為Apple和Google）的規範。

§28 [申訴]

您可針對本《服務條款》所述的「Cloud Joy Games服務」提出申訴（以下簡稱「申訴」）。若您針對「Cloud Joy Games服務」不符合「協議」規範的情形提出申訴，我們會依據適用規定（包括本《服務條款》第§28(2)至§28(7)條的規定）審查「申訴」。

若從Cloud Joy Games的聲明或相關情況可清楚判斷Cloud Joy Games不會提供「內容」或「服務」（例如Cloud Joy Games未在14天內提供「內容」或「服務」，也並未與您聯絡），您可以解除「協議」，而不另外要求Cloud Joy Games提供「內容」或「服務」。若您已與Cloud Joy Games做好安排，或是從相關情況可清楚判斷Cloud Joy Games不會在對您至關重要的時限內提供「內容」或「服務」，您也有權解除「協議」。

若「Cloud Joy Games服務」不符合「協議」規範，您可以透過「申訴」要求Cloud Joy Games依據「協議」提供「Cloud Joy Games服務」。若要求有其正當性，Cloud Joy Games應在您向Cloud Joy Games妥善告知這類不合規情事後的合理時間範圍內（通常是14天），依據「協議」提供「Cloud Joy Games服務」。Cloud Joy Games應負責處理相關程序，依據「協議」提供「Cloud Joy Games服務」，而不對您造成過多不便。不過，Cloud Joy Games可能會請您在這方面進行配合，尤其是向Cloud Joy Games提供Cloud Joy Games所要求的必要資訊（特別是第§28(9)條所述的資訊）。在依據「協議」提供「Cloud Joy Games服務」的過程中，Cloud Joy Games應考量「Cloud Joy Games服務」的性質和預期用途。

若Cloud Joy Games未能依據「協議」提供「Cloud Joy Games服務」，或是未能履行上方第§28(3)條所述的義務，您可以要求降價，或是解除與該「Cloud Joy Games服務」相關的「協議」。在以下情況下，您也具有上述權利：

根據「協議」提供「Cloud Joy Games服務」無法實現，或是這樣做會產生過多成本。評估是否會產生過多成本時，Cloud Joy Games會考量個案的各種情況，尤其是不符合「協議」規範一事的影響程度，以及相關不合規「Cloud Joy Games服務」的價值。

Cloud Joy Games在考量「Cloud Joy Games服務」的性質和預期用途後，並未按照上方第§23(3)條的規定（即在您向Cloud Joy Games告知不符合「協議」規範之後的合理時間範圍內採取行動，且不會對您造成過多不便）依據「協議」提供相關「Cloud Joy Games服務」。

雖然Cloud Joy Games已嘗試依據「協議」提供「Cloud Joy Games服務」，但「Cloud Joy Games服務」依然不合規。

「Cloud Joy Games服務」不符合「協議」規範一事影響甚鉅，足以證明降價或「協議」解除要求的正當性，而不必行使權利，要求Cloud Joy Games按照第§28(3)條的規定依據「協議」提供「Cloud Joy Games服務」。

從Cloud Joy Games的聲明或相關情況可清楚判斷Cloud Joy Games不會按照第§28(3)條的規定，依據「協議」提供「Cloud Joy Games服務」。

若您要求降價，則其與「協議」產生價格的比例必須跟不合規「Cloud Joy Games服務」價值與合規「Cloud Joy Games服務」價值的比例相同。若我們僅提供部分「Cloud Joy Games服務」，或是以持續的方式提供「Cloud Joy Games服務」，降價幅度也應考量「Cloud Joy Games服務」不合規的時間長度。

若我們是因為您支付相關款項而提供「Cloud Joy Games服務」，且不符合「協議」規範一事影響輕微，則您不得解除與「Cloud Joy Games服務」相關的「協議」。

若您解除「協議」，Cloud Joy Games可禁止您進一步使用「Cloud Joy Games服務」，尤其是封鎖您的「Cloud Joy Games服務」存取權或「帳號」。

若要提交「申訴」，請透過「網站」的「支援」專區或「使用者帳號」的「協助」專區傳送訊息。

「申訴」應至少包含使用者名稱、使用者ID（UID）、電子信箱地址、「申訴」主題、可證明「申訴」合理性的相關情況資訊，以及「使用者」預期的解決方法。

Cloud Joy Games必須在「申訴」提交日算起的14天內盡快審查並回應「申訴」。

若您有提供電子信箱地址，Cloud Joy Games會將「申訴」回應傳送至該地址。若未提供，Cloud Joy Games應使用其他方式與您聯絡，尤其是透過「帳號」聯絡。

若「使用者」對我們的「投訴」回應或解決方法不滿意，可以向管轄法院提出訴訟。「使用者」保有依據適用法律尋求司法救濟的所有權利。

§29 [通知]

除非本《服務條款》另有說明，否則Cloud Joy Games與您應透過電子通訊管道聯絡（包括提供任何通知、資訊和聲明）。

您可以透過「網站」的「支援」專區或「帳號」的「協助」專區聯絡Cloud Joy Games。

Cloud Joy Games可透過電子信箱地址（若有提供）和「帳號」中可用的通訊管道與您聯絡，且若您接受本《服務提款》，即表示您瞭解並同意我們這麼做。

Cloud Joy Games會傳送郵件至與「帳號」連結的電子信箱地址，或透過「帳號」中可用的通訊管道，向您提供法律要求的資訊。若Cloud Joy Games未取得您的電子信箱地址（尤其是當您透過「第三方平台」使用「Cloud Joy Games服務」時）、您的電子信箱地址無效或已取消，或是基於其他原因無法透過電子郵件與您聯絡，Cloud Joy Games應使用「帳號」中可用的通訊管道。

§30 [技術支援]

Cloud Joy Games會向「使用者」提供客戶服務。

如需客戶服務，您可以透過「網站」的「支援」專區或「帳號」的「協助」專區聯絡Cloud Joy Games。

客戶服務為免費，且無論是否有註冊「帳號」都可使用。

針對Cloud Joy Games的「Cloud Joy Games服務」提供情形，您可以就任何相關面向提出要求，尤其包括但不限於：

無法存取「遊戲」、「帳號」或任何其他「Cloud Joy Games服務」；

「遊戲」或「帳號」中的技術問題；

付款轉帳問題。

我們會致力盡快回覆。在大多數情況下，我們的目標是在收到您的詢問後14天內回覆，特別是涉及投訴或關於不符合規範的正式請求之事項。

§31 [可分割性]

您與Cloud Joy Games同意，若具法定管轄權的法院判定本《服務條款》的任何條款全部或部分違法或無法執行，則針對這類法院的管轄區，該條款只有在符合以下條件的情況下才無法執行：經判定為無效或無法執行，而不會影響其在其他管轄區的有效性或可執行性，也不會影響本《服務條款》的其他條款（其他條款應保持完全有效）。

§32 [不構成拋棄權利]

即使Cloud Joy Games未能要求或強制您嚴格遵守本《服務條款》的任何條款，或是行使本《服務條款》賦予的權利，亦不得解釋為Cloud Joy Games拋棄或放棄後續要求或援引這類條款的權利。

除非本《服務條款》另有具體明文規定，否則Cloud Joy Games的任何陳述、聲明、同意、權利拋棄或其他疏忽行為皆不應視為對本《服務條款》的修改，亦不具有法律效力，但若有相關書面紀錄，且當中包含您與妥善委任的Cloud Joy Games主管雙方的手寫簽名，則不在此限。

§33 [不可抗力]

若因超出Cloud Joy Games或您控制範圍的因素，導致未在時限內或無法履行本《服務條款》規定的義務（包括但不限於超出Cloud Joy Games或您控制範圍的意外情況或因素導致無法履行「協議」），則Cloud Joy Games或您無須承擔任何責任。這類因素包括天災、戰爭、恐怖主義行為、暴動、禁令、民政或軍事主管機關的行為、火災、水災、意外事故、罷工，或是運輸設施、燃料、能源、人力或原料短缺。

§34 [使用者聯繫點]

如果您對Cloud Joy Games服務或本協議有任何問題或疑慮，請透過網站或使用者帳號中的「支援」、「幫助」、「聯繫」或類似選項聯繫Cloud Joy Games的支援團隊，並提交您的問詢。Cloud Joy Games支援團隊是與Cloud Joy Games溝通的唯一聯繫點。

§35 [舉報與透明度]

Cloud Joy Games 致力於維持其對使用者內容審核的透明度，並定期發布有關這些活動的報告。

Cloud Joy Games 採用明確且透明的程序來審核使用者內容，包括移除、限制可見性，以及封鎖不符合任何當地法律、本協議或 Cloud Joy Games行為準則的使用者內容。

關於使用者內容審核的決定是基於明確的指導方針和標準，這些都在本協議中有詳細說明。

Cloud Joy Games 承諾每年發布使用者內容審核報告。這些報告將透過網站提供，並特別包括：

收到的關於非法內容的舉報數量；

收到來自成員國當局的命令數量；

來自可信舉報者的舉報數量；

針對舉報採取的所有行動，分類說明行動是基於法律要求還是協議，使用自動化方式處理的舉報數量，以及採取行動的中位數時間。

§36 [修訂]

Cloud Joy Games保留權利，可隨時基於至少下列其中一個有效原因修訂本《服務條款》：

對於Cloud Joy Games與您彼此的權利和義務（尤其是關於提供數位內容與服務，以及依據本《服務條款》所述的電子方式提供服務）做出規範或造成影響的法律有所異動、因法院裁決、判決、建議，或相關主管機關或機構的規範導致對這類提供行為的解讀有所異動，以及影響您與Cloud Joy Games之間關係的法律有所異動；

因技術或科技因素導致「Cloud Joy Games服務」的提供方式有所異動；

新「Cloud Joy Games服務」推出或現有「Cloud Joy Games服務」終止導致「Cloud Joy Games服務」的提供範圍或方式有所異動；

Cloud Joy Games合作對象的合約或服務條款經過修訂，導致「服務」的提供方式有所異動；

排除《服務條款》內容在解讀方面的不確定性和模稜兩可之處；

某項「Cloud Joy Games服務」中的功能有所異動、發展或遭到刪除，或是必須配合這類功能的更新調整本《服務條款》；

「Cloud Joy Games服務」進一步在新平台上推出；

本《服務條款》提及的Cloud Joy Games企業詳細資料有所異動。

若本《服務條款》經過修訂，Cloud Joy Games應向您告知，並將修訂版《服務條款》內容發布在「網站」上提供給您；若您有「帳號」，則應一併將修訂版《服務條款》內容傳送至與「帳號」連結的電子信箱地址，或是在「帳號」中提供給您。若Cloud Joy Games未取得您的電子信箱地址（尤其是當「使用者」透過「第三方平台」使用「Cloud Joy Games服務」時）、您的電子信箱地址無效或已取消，或是基於其他原因無法透過電子郵件與您聯絡，Cloud Joy Games應透過「使用者帳號」向您提供修訂版《服務條款》內容。

《服務條款》修訂內容會在「使用者」收到修訂通知的7天後生效。若您不接受經過修訂的《服務條款》，您有權在經過修訂的《服務條款》生效前，透過「網站」的「支援」專區或「帳號」的「協助」專區終止「協議」，而不另行通知。

如果我們必須根據法律、法院判決或相關主管機關的類似行為，以快於上方第§36(3)條規定的速度修訂《服務條款》，Cloud Joy Games應通知您。通知應包含我們之所以要這麼快進行修訂的原因，以及修訂內容的生效日期。

§37 [其他及適用法律]

如需《服務條款》的現行版本，請前往：服務條款 。

在適用法律的允許範圍內，Cloud Joy Games的註冊辦公室應視為依據本《服務條款》提供服務的地點。

本「協議」應完全受中國香港特別行政區法律的規範。

在最大的可能範圍內，衝突法條款應受到排除，且中國香港特別行政區法院具有專屬管轄權。

即使本《服務條款》的任何部分經判定為無法執行，也不應影響本《服務條款》其他部分的可執行性。

在本《服務條款》所涵蓋的範圍內，本《服務條款》自本文註明之日期起應取代Cloud Joy Games先前的任何相關安排。
